Iraqi family embraces life with old enemy

FOUR years after the al-Saadi family's lives were shattered by a Digger's spray of bullets in Baghdad, the Iraqis are making a new start in Australia following the granting of permanent residency.

In that fateful instant, on the evening of February 26, 2005, shop owner Nezar Saadi, his wife Lamyaa and their three young children - crowded into a Volkswagen as they returned home from a family function - were shot by a patrolling Australian soldier who mistook them for the enemy. Now, settled in Brisbane just suburbs away from the Digger who fired the volley of shots that maimed Mrs Saadi and youngest son Ahmed, the family of five has embraced the local lifestyle and professes gratitude to a country whose soldiers nearly killed them.

Both Ahmed, 13, and his older sister Shaymaa, 16, are typical Australian kids - loaded with energy and carrying mischievous smiles. They are both at high school, having studied English since their arrival for medical treatment in 2007, and talk of sports and their mates in broad Australian accents.

"We have really good friends at school," Shaymaa said.

Both play a range of sports, with their favourite, soccer, being the subject of typical sibling banter about who is the better player.

Mr Saadi is studying English, in preparation for entering the workforce. His wife is looking after their youngest daughter, Reem, 5, and herself, after bearing the brunt of the bullets and shrapnel that peppered their car in 2005.

Through an interpreter, Mrs Saadi said her children had fitted in well at school.

"They have been treated well and have made some good friends in Australia," she said.

Mrs Saadi can't get over the abundance of food compared with Iraq, which endured years of rations before the start of the war, and then massive shortages after the US forces took Baghdad.

"It's amazing - there's nothing I can't get here," she said.

In the attack, Mrs Saadi lost the sight in her left eye, suffered skull and jaw fractures, hearing loss and scarring to her face.

Ahmed, then aged 8, was blinded in his right eye.

Mrs Saadi still has severe headaches and may soon have further plastic surgery and be fitted with an artificial eye.

All of them were traumatised by the shooting and still undergo counselling.

The soldier who fired the shots was medically discharged months later, suffering from post-traumatic stress disorder.

Although the Saadis are not the only innocents to be injured by Australian forces in Iraq or Afghanistan, Immigration Department officials say they are the only known victims of either war to be brought to Australia for specialist medical treatment. Last year, they were granted permanent residency - also a first of its kind - in a move that appears to put to rest doubts about Australia's culpability in the attack on the family.

The Department of Defence has refused to release the report of the internal investigation into the shooting, but the secret report is likely to become the subject of a legal tug-of-war.

Last year, the Saadis made Australian legal history by launching civil action in Queensland's Supreme Court, seeking compensation for their injuries.

The case is set to test the assertion by Chief of the Defence Force Angus Houston that the commonwealth is not "legally liable" for injuries inflicted in ADF military operations.

The Saadis' solicitor, Rod Hodgson, a partner at Maurice Blackburn lawyers, said the government had treated the family well in Australia.

But Mr Hodgson said the standard of care and approval for permanent residency did not excuse the government from liability for the damage they had caused the family.

"The issue of compensation is distinct from that of their status as permanent residents, and the court proceedings remain on foot," he told The Australian.

"When we have some clarity as to prognosis, we are hopeful of having discussion with the government and resolving the court action.

"The government has been very sensible, compassionate and demonstrative of good will in their treatment of the family."

The Department of Defence last night failed to respond to questions about the case supplied last Thursday.

Through their lawyers, the Saadis said they were trying to put the pieces back together and create a brighter future for their children in Australia.

While the Saadis are the first to be allowed to live in Australia because of injuries inflicted by Australian troops, there are hundreds of other Iraqis who have been granted residency visas because of the assistance they gave to Australian forces.

Last year, the Rudd government said Iraqi employees, including translators and interpreters, would be able to apply for resettlement in "recognition of the personal security situation they will face" for their work with Australian forces.

The visas would extend to the employees' immediate families.

Immigration department figures show that up to last month, 450 Iraqis have arrived in Australia, with another 50 visas having been granted.

These people will cost Australian taxpayers hundreds of millions of dollars over their and their families lifetime’s, with a never ending supply of social security benefits and FREE for life medical and dental treatment along with Free or heavily subsidised housing and an endless supply of family reunion “relatives” who are, for what ever reason granted residency in Australia over the coming years by a lick spittle Socialist Labor government and PM,”Kevin 07”  obsessed with engratiating themselves to their International Socialist masters at the United Nations.

Terror plot suspect 'planned big attack'

Three men who allegedly plotted to kill soldiers at a Sydney army barracks are applying for bail.

One of the five men charged over an alleged suicide terrorism plot to kill soldiers at an Australian army barracks was keen to "strike big" if permitted under Islamic law.

Three of the men charged over the plan to attack the Holsworthy army barracks in Sydney -

Saney Edow Aweys, 26, of Carlton North, Nayef El Sayed, 25, of Glenroy, and Yacqub Khayre, 22, of Meadow Heights - are applying for bail in the Melbourne Magistrates' Court.

Co-accused Abdirahman Mohamud Ahmed, 25, from Preston, is expected to apply for bail at a later date. Another co-accused, Wissmam Mahmoud Fattal, 33, who thinks prison is like an "eight-star hotel", did not apply for bail.

Translations of secretly recorded telephone conversations involving the accused were read to the court by federal agent Chris Salmon.

Agent Salmon said Fattal was the central figure in the plot and was already in prison over an assault at a Preston mosque.

"I would like to strike big if it's Halal (permissible under Islamic law)," El Sayed told Fattal on April 7.

During a prison visit on May 3, Fattal and El Sayed discussed Fattal applying for bail, the court was told.

"We are working together on a great, monstrous thing," Fattal told El Sayed.

"We need to persevere.

"There is no point coming out. If the work is ready I will come out."

In another conversation on July 10, Aweys confided in Somali Sheik Abdirahman about accessing guns for their plan.

"Their desire is to fan out as much as possible until they would be hit," Aweys told the sheik.

"Twenty minutes is enough for us to take out five, six, 10, eight."

Aweys asked the sheik if the plot was permissible. Noting there could be horrific consequences, the sheik raised the idea of a mass exodus of Muslims, with those left behind to "carry out the activity".

All of the five accused are charged with conspiring to attack the Holsworthy base. Aweys is also accused of abetting Walid Osman Mohamed to engage in a hostile act in Somalia.

On July 25, the pair was engaged in a telephone conversation, in which Aweys confirmed he had sent money to Mohamed, the court was told.

From Somalia, Mohamed told Aweys he planned to hold a PKM heavy machine gun in the frontline.

"Holding this and being the target at the front is the closest thing to martyrdom," he said.

Khayre was tasked by El Sayed to travel to Somalia to obtain a fatwa to authorise a terrorist attack in Australia.

He left on April 13 and, having obtained a fatwa, returned to Australia on July 14.

Agent Salmon said each defendant has indicated a willingness to leave Australia to go to Somalia to fight.

When asked by El Sayed's lawyer, Julian McMahon, if he tipped off The Australian newspaper about the investigation, agent Salmon said he did not.

Asked if he knew who was responsible for the leak, agent Salmon said he wanted to seek advice from legal counsel before answering that question.

The hearing before Magistrate Peter Reardon was subject to tight security, including weapon detectors and armed officers.

The hearing continues on Tuesday.

THEY might have had no English and no experience - but for $300 students at the state's biggest security training school allegedly walked away qualified in just one day.

Meanwhile their "trainers" - whose jobs amounted to little more than marking exam papers for which the answers had already been supplied - earned huge sums.

That was the damning picture of Roger Training Academy, which churned out a quarter of the state's accredited security guards until it was shut down in March, presented to the ICAC yesterday.

The commission heard the western Sydney college gave students answers to exam questions in advance, issued first aid certificates without training and faked resumes. It allegedly had its staff write out students' exam answers for qualifications that included gun handling, basic English, and conflict negotiation.

Students were charged between $300 and $500 for the same-day service - payable in cash only.

"Toward the end there were a lot of students who were walking in, who I didn't know from a bar of soap, who were just writing out the (supplied) answers," a trainer, Dru Hyland, told the commission. "It was definitely dishonest, Your Honour."

Mr Hyland agreed the practice amounted to corruption but said he was under pressure from the company's principal, Ahmed Mossani, and the students themselves.

Recorded telephone calls showed Mr Hyland less remorseful.

He told a friend he made $150,000 in five months - equivalent to a senior parliamentarian or CEO.

He enjoyed his newfound riches, telling the friend he used the cash for a holiday in Vanuatu, had splashed out cash on a new motorbike, four-wheel drive and another new car for his wife and set up his own business.

"I've had the money to do stuff I've been trying to do for so long," he said. "I've now got an opportunity to earn a great whack in a short period of time."

He denied the $150,000 figure - saying it was closer to $90,000 - explaining he had a "slapstick" relationship with the friend and he was exaggerating.

The commission heard more than $1.3 million was deposited into Mr Mossani's bank accounts between August 2007 and April 2009.

Counsel assisting, Carolyn Davenport SC, said: "Subverting the correct assessment process created an opportunity for persons at Roger to make large sums of money."

Mr Mossani is expected to give evidence later this week.

The inquiry continues today.

Highway speed police were racists, says caught driver

NO One denies that when highway patrol officers chased an allegedly speeding driver they manhandled him from his car and threw him to the ground. But Jamal Ejaidi  claims it was because he was Lebanese.

The arresting officers say different. Senior Constable Brett Rossiter said he treated Ejaidi the same as he treated nine out of 10 drivers after a chase and denied he was being violent or racist.

Graphic vision captured by the highway patrol car camera was played in Bankstown Local Court yesterday showing Ejaidi being dragged from his car and then out of sight of the camera.

Defending the way he acted, Constable Rossiter said he needed to take control of the situation for his safety and the safety of other officers.

But Ejaidi's lawyer Greg Walsh said: "Without even asking them to produce their licence? You resort to violence?"

It is alleged that Ejaidi was stopped after a police pursuit which lasted just 30 seconds through Punchbowl on October 16 last year.

Ejaidi, 22, of Riverwood has pleaded not guilty to driving his rotary-charged Mazda RX8 in a dangerous manner and not stopping when directed to. Mr Walsh told the court the arrest should have not only been captured on camera, but recorded for sound to safeguard the police as well as the alleged offender.

But Constable Rossiter said he did not take the microphone out of the patrol car with him. "I forgot," he said.

The police allege that they followed Ejaidi in his green Mazda which was driving erratically in company with a red Nissan Pulsar SSS. When they pulled the Nissan over, Ejaidi sped past doing up to 100km/h in a 50km/h zone.

With sirens and lights, the police gave chase and Ejaidi stopped in Punchbowl Rd.

Constable Rossiter said: "We got him down on the ground. My knees were then on his back to restrain him on the ground while I brought his arms around to handcuff him."

Constable Rossiter and his partner Senior Constable Aaron Sheldrick denied deliberately moving Ejaidi out of sight of the police camera.

The court was told Ejaidi has made an official complaint to Police Commissioner Andrew Scipione about the behaviour of the two officers, alleging he was assaulted.

Both officers denied a suggestion by Mr Walsh that they swore at Ejaidi, telling him "f . . . ing smart-arse Lebbo. You're f . . . . d".

Mr Walsh told the court that six months later, Constable Sheldrick pulled Ejaidi over again.

He gave Ejaidi a defect notice and then asked him what Mr Walsh was charging for his defence, it was alleged.

Mr Walsh said that Constable Sheldrick then asked Ejaidi to go to McDonald's with him for a coffee to "sort this out".

The accusation was not put to Constable Sheldrick yesterday before the court adjourned.

It would be great if the officers concerned did in fact use the words “"f . . . ing smart-arse Lebbo. You're f . . . . d". It would indicate a willingness on the part of at least one or two NSW Police officers to speak the language of the buyer.

Ask any Australian’s unfortunate enough to still be living inside Sydney’s Occupied Territories, what it’s like driving on the roads with these arse clowns displaying their macho cultural diversity via their girly man cars, breaking every traffic law written and been totally untouchable by the NSW Police.

Caning delayed for beer-drinking model

Officials say the caning of a Muslim model who was apprehended for drinking beer has been postponed until after the Islamic fasting month.

Kartika Sari Dewi Shukarno originally had been scheduled to enter a women's prison on Monday before being lashed six times with a rattan cane some time this week.

However, Mohamad Sahfri Abdul Aziz, a legislator in charge of religious affairs, says the caning will be carried out after the current Muslim fasting month of Ramadan. It began on Saturday and will end in mid-September.

He says the decision was made at the last minute for compassionate reasons on the advice of the Attorney General's office.

Evil rapist brothers locked up

THEY were brothers who teamed up for a terrifying week-long rampage of rape and robbery.

But when Abraham Hzaife, 39, was sentenced to 15 years in jail yesterday and Ahmed Hzaife, 22, got 14 years, they showed vastly different emotions.

The brothers pleaded guilty to charges related to robberies and attacks on massage parlours and brothels in Sydney's west in 2007.

Both had also been found guilty of a single count of aggravated sexual assault, having both denied the charge.

A number of victims applauded and yelled "justice has been served" as the brothers stood to leave Parramatta District Court to the sounds of their weeping mother.

Abraham Hzaife, of Woodpark, yelled "go f . . . yourselves" across the court and angrily shouted at a security guard as he tried to speak to his sister.
\In contrast, Ahmed Hzaife, of Merrylands, sat slumped with his head in his hands, wiping away tears.

The court heard the pair had embarked on a week-long crime spree from November 28 to December 5, including a violent robbery on a premises in Seven Hills.

The brothers robbed Ron Adams and his housemate - an erotic masseuse referred to as DW in court to protect her identity - at knife point at their Seven Hills house on November 29.

Each man then raped DW, taking turns to force her to perform sexual acts as they sat on a lounge chair.

Outside court Mr Adams said the sentence was "unsatisfying", but he was pleased to look both men in the eye before they were taken back to jail.

"In the end, what compensation do I get for what they did to me?" he said.

Another victim, who did not want to be named, said justice had been served.

"Two violent criminals are now where they ought to be," he said.

"Anyone who has been a victim of a similar crime should come forward."

Abraham Hzaife had been taking a mixture of ice, cannabis and alcohol during the crime spree.

He was sentenced to 11 years non-parole ending April 28, 2019, with a further four-year parole ending on April 28, 2023.

The pair also robbed victims of cash, mobile phones and a clock radio.

Rape victim's nine-hour ordeal

HE PLAYED the part of a knight in shining armour, offering a 15-year-old girl safety when she could not protect herself.

But that same man turned attacker, leading two of his friends in a horrifying gang rape.

Her three-year fight for justice ended yesterday as a jury found three Zambian nationals guilty of aggravated sexual assault without consent for the attack in August 2006.

The main attacker, Likumbo Makasa, was also found guilty of charges of having sex with a child under 16.

The chequered history of the matter can now be revealed - there have been two aborted District Court trials and this one, meant to take a month, has lasted well over three months.

Makasa, Tyrone Chishimba and Mumbi Peter Mulenga had pleaded not guilty and faced a trial on a total of 30 charges between them arising out of the incident in Hurstville.

The court heard that the girl, who cannot be identified, had been drinking alcohol with friends when she was met by two of the accused - Makasa and Chishimba - who bought the group bourbon and cask wine.

The teenager passed out drunk in a 7-Eleven store and Makasa offered to take her back to his unit so she would not be picked up by the police.

After they arrived at the unit, police said, Makasa, a married nurse who has been a permanent resident for three years, showed her a hand gun.

The girl told police she was intoxicated and vomited once.

She passed out again and later told the trio that she was still drunk and wanted to sleep.

The court heard that the girl did indeed fall asleep, only to awake to the horror of a man on top of her having intercourse, to which she had not consented, with the other two watching.

All three were found guilty of aggravated sexual assault in company. Makasa faced additional charges for having sex with the underage victim for another nine hours after the other men left his unit. He was found guilty of three of those.

The trial heard allegations that for two hours after the initial assault, the trio repeatedly raped the girl.

However, the jury did not convict them on those charges.

The trio, two of whom have no prior criminal record, face a minimum of 10 years' jail. Judge Graham Armitage remanded them in custody to face court in October for sentencing.

Omega was on the way home from an Australia Day celebration with his family.   He’d been at a park at North Burleigh.He was your typical Aussie bloke, a knockabout fella, enjoying being an Australian on Australia Day.

7 months after he was shot and killed, police have 4 “persons of interest” that they want to speak to.They know who they are.I will try to be as charitable as I can here.Police seem scared to arrest the criminals.

As a result the Crime and Misconduct Commission has been asked to summon the 4 men to appear – not in court, not in a police station, not to be interviewed by police – but to appear before the Crime and Misconduct Commission.

And the reason? As the CMC’s Assistant Commissioner John Callanan has told our Supreme Court in a sworn affidavit “traditional police strategies could not get information from potential witnesses entrenched in the organised crime culture of Middle Eastern and outlaw motorcycle gang crime syndicates.”

I am amazed to be reading this.He goes on to say that in some cases witnesses were “aggressively and even violently anti-police.”

What?   We have 4 people who are allegedly implicated in the shooting death of a lovely bloke, one of our own, a father of two – shot dead in cold blood on Australia day and the police are reluctant to pick up the crooks?

Here’s what we know.The CMC has summoned 4 men to appear before the CMC to give evidence about what happened on Australia Day.The 4 “persons of interest” have politely declined to attend. The 4 have mounted a legal challenge in the Supreme Court.It’s like a legal challenge against being arrested and interviewed.

So now documents have been submitted to the Supreme Court.You or I can go to the court and read them.They are very, very scary reading.

CMC Assistant Commissioner John Callanan has filed an affidavit stating what allegedly happened to Omega Ruston.

According to the material before the Supreme Court, Omega Ruston was driving home with two mates along the Gold Coast Highway when his ute was cut off at Miami by 3 men in a red sedan.

Keep in mind this is a sworn affidavit from Commissioner Callanan.

“The occupants of each vehicle have them become involved in a verbal exchange while seated in their respective moving vehicles.Expletive hand gestures have been exchanged.”

The cars kept travelling south.Mr Ruston pulled over at Burleigh Heads and the other car pulled up about 15 metres behind him

Mr Ruston got out of his car and stood by the driver’s door.One of Omega’s passengers also got out and walked back towards the other car.

Now according to this affidavit from the CMC’s Assistant Commissioner, Omega’s passenger allegedly saw “a Lebanese man” who was sitting in the back seat of the red sedan. He was allegedly holding a black handgun, “possibly a semi or automatic firearm.”

He described the man as in his mid-20s, short black hair, olive complexion and muscular build.He was wearing a tight, white T-shirt.

The man from Mr Ruston’s vehicle also said he saw “Lebanese” males in the front passenger and driver seats.

The red car then pulled out and drove up beside Mr Ruston.At this stage the second passenger in Mr Ruston’s ute describes what he saw.

He says he saw the Lebanese man in the back of the sedan allegedly point a black handgun through the rear passenger window.

“The male person rested his wrists on the window and fired two consecutive shots at the deceased.” That’s a quote from the court document.

We know that Mr Ruston died from a gunshot wound to the stomach.2 little children have no dad.

The police have identified 4 persons of interest.Such is the culture of our community that the police have referred this matter to the CMC.

Not surprisingly, the 4 “persons of interest” have declined the CMC’s summons to appear to give evidence before the CMC.They have applied for a Supreme Court review of the CMC’s summonses for them to appear before the CMC.

It’s in the court documents before the Supreme Court that we get a sense of where our community is headed.

Why the police do not simply knock down a few doors and make arrests is beyond me.

The Queensland Police Service referred the case to the CMC for the CMC to investigate, using its coercive powers.

The CMC believes this is the right thing to do because potential witnesses are “entrenched in the organised crime culture of Middle Eastern and outlaw motorcycle gang crime syndicates.”

The CMC says some are “aggressively and even violently anti-police.”

The persons of interest have applied to the Supreme Court for the CMC to have over confidential information Queensland and NSW police have on the murder.

Who is running this country? What the hell have we become when police appear to be afraid to confront criminals?  Why the delay in justice for the family of Omega Ruston?  Is the CMC an alternative police force?  Can criminals avoid arrest by going to the court and politely refusing requests to be interviewed?

There are many questions to be answered on this matter.Omega Ruston, knockabout Aussie father of two, shot dead on Australia Day.His memory deserves much, much better.

Last week we spoke about Australia’s contribution to what Mr Rudd calls global carbon pollution.

Keep in mind that 97% of the carbon dioxide in the atmosphere gets there through Mother Nature.

And that carbon dioxide makes up just 380 parts per million of the atmosphere.

So as we said last week, Australia’s contribution to the so-called problem is miniscule.

If you think of 100% of the atmosphere as 1 kilometre, then Australia’s contribution to the so-called problem of carbon pollution is less than 1 millimetre, about the size of a human hair.

One hair per Gateway Bridge of atmosphere to clean up.

But Mr Rudd’s new tax won’t get rid of the hair.

The incredible thing is that this entire new tax system is not designed to blow the hair away.  All the pain, all the angst, all the price rises – are designed to reduce the size of the hair by 5%!

And now we’re starting to see how much the new tax will cost. A tax on our people that India, China and other nations won’t impose on their people.

Taxing everything is not a by-product of the scheme. It is the central purpose of the scheme.

When the GST was brought in, the level was set at 10%. That was set in concrete.   But the new emissions tax is designed to increase every year.It’s potentially infinite in its cost to you.

And it’s probably no surprise that large sections of the business community support the scheme.   Why?   Money.   As Glen Milne reports in The Australia this morning by way of one example, KPMG is charging companies $250,000 to audit individual facilities – that is every location – to determine their carbon output.Imagine the money in that.

This scheme will change Australia forever – yet the tax side of the scheme has hardly been debated at all.All we see on the news is pictures of smoke stacks.

Barnaby Joyce is the only political voice warning about the headlong rush we’re on.From a cost perspective, I can see nothing good for the broader community in this new tax at all.

Food prices to surge under emissions trading scheme

SHOPPERS face a jump in grocery prices of up to 7 per cent under Labor's scheme to reduce carbon emissions, prompting calls for the Rudd government to come up with a compensation package to help low- and middle-income families.

Big retailers have warned the government that the proposed emissions trading scheme would add between 4 and 7 per cent to shopping bills in what would be a de facto tax on food.

Although the government has revealed plans to compensate households for increased energy prices when the ETS is expected to be introduced in 2011, it has yet to announce how it will cover the rise in grocery prices.

Reserve Bank assistant governor Philip Lowe last week told the House of Representatives economics committee that the ETS would add 0.4 percentage points to the Consumer Price Index measure of inflation in its first year of operation.

However, the Food and Grocery Council believes the increase in grocery prices would be much higher, about 5 per cent.

As food and grocery shopping is estimated to take up to 20 per cent of the weekly household budget, the council's chief executive, Kate Carnell, says the price rise will amount to a GST on food - the area the Howard government exempted from the tax after a prolonged campaign by Labor and the Australian Democrats.

Large retailers are understood to have also done modelling showing similar results, including a rise in food prices of as much as 7 per cent should Australia adopt the 25 per cent target on emissions reductions by 2020.

Large retailers, while privately concerned, are believed to be hesitant to voice their objections to the ETS for fear of tarnishing their reputation among environmentally conscious consumers.

Australian Retailers Association executive director Russell Zimmerman said the ETS would lead to a sharp increase in grocery shelf prices as costs increased at every stage of the production and distribution process.

"It's going to be a high cost to the consumer - the food manufacturer gets an ETS charge, then there's delivery, and the retailers use refrigeration and lighting, and the cost of that is all going to be handed on," Mr Zimmerman said. "Retail is a very competitive business. There's not a lot of margin in grocery retailing, so these costs can't be absorbed."

The ARA has set out its concerns in a submission to the government's green paper on carbon reduction but Mr Zimmerman said he had little hope the government would shield consumers from higher costs.

"The government has said it will cost consumers $1 a day, but that fails to accurately calculate the retail price impact on consumers, and there's no real handle on what it's going to cost consumers in the end," he said.

Retailers' anxiety is matched in the US, amid growing fears about the impact of carbon trading plans. US agriculture companies including grain giant Cargill, meat processor Tyson Foods and food-maker General Mills, have expressed concern they will bear an unfair proportion of the costs resulting from carbon-reduction legislation and warned this would lead to higher food prices.

Nationals senator Barnaby Joyce has warned that the ETS, once in place, would raise the retail price of a leg of lamb to almost $100.

The revelations on food prices come as a split emerges in the business community over the ETS. The peak group, the Business Council of Australia, is divided over its position on the plan to reduce carbon emissions.

The BCA is torn, with finance sector elements backing the ETS and the mining industry vehemently opposed. The split has led to the circulation of an anti-ETS paper from within the BCA that concludes 67 of its 109 members will not have a carbon permit liability under the government's proposed Carbon Pollution Reduction Scheme.

The overwhelming majority of the 67 are in the finance, legal or legal services sector, which the analysis says are expected to make huge profits out of the ETS.

The paper's author, who does not wish to be named, concludes: "While the BCA is held up as the voice of industry on the carbon scheme, the vast bulk of its members have no skin in the game. That is, they won't have to buy permits. In fact, the bankers and finance consultants like KPMG stand to make a fortune out of it."

The paper's author also names at least 12 senior Labor figures - seven of them frontbenchers, including three cabinet ministers - who they say have expressed doubts about the government's ETS privately to either BCA member companies or their industry group representatives.

Emissions trading is a tax, no matter the name

THE first and most important thing to note about Kevin Rudd's emissions trading scheme is that it is a tax.

It's not called a tax, but if it waddles like one, quacks like one, and most pointedly raises money like one, it's a tax. And not just any old tax -- it's a huge and continually growing tax.

It starts out in 2012-13 raising about a quarter as much as the GST. The budget in May put a number on it for the first time. Almost $12 billion in its first full year, 2012-13.

It is the equivalent of increasing the GST from 10 per cent to 12.5 per cent in that year. And in its impact on people it won't be all that different from doing exactly that.

In year one, that is, which if we actually get the ETS should be retitled Year Zero, because it will be the beginning of the end of Australia as we know it.

Crucially and very ominously, there is no, if you'll pardon the pun, cap on this insidious version of a GST. The effective rate could double or triple, the amount of money raised could skyrocket. Indeed, it is intended to do exactly that, with no referral back to parliament for endorsement.

Imagine the uproar if the government had proposed raising the GST to 12.5 per cent. That's 12.5 per cent, in year one, with it able to go to 15-20 per cent or higher, as events, not parliament, then took it. The uproar would have been loudest from the Labor Party.

Hey, but it's not a tax, it's a scheme. Indeed, the ETS was specifically chosen in rejection of a carbon tax. That's a tax.

Oh, for the benefit of hindsight. If only John Howard and Peter Costello had called it their GSTS, they would not have heard a peep out of media or opposition. It's not a tax, it's the Goods and Services Trading Scheme.

Simple. Instead of adding a tax of 10 per cent to the price of (almost) everything, you bought permits to allow you to sell goods and services, for what just happened to equal 10 per cent of the price you wanted to charge.

They and their GSTS would have had a charmed run -- I don't think.

On one level the ETS title is of a piece with the fundamental dishonesty of the government's overall so-called carbon pollution reduction scheme.

It has nothing to do with carbon as carbon, far less pollution, but with emissions of pure carbon dioxide -- without which there would be no life on earth.

It's not quite as dishonest, as it is after all about trading permits to emit -- although humans won't require such a permit to breathe out. At least, to be fair, not initially.

The ETS -- the Americans are calling their proposed version cap and trade -- sets an overall target each year for (non-human) CO2 emissions, and the government sells the permits to emit.

The tax is a tax is a tax. You can buy and sell the permits -- the very secondary trading in cap and trade. The alternative carbon tax would simply have applied a direct tax on emitting carbon dioxide -- I doubt you can emit carbon.

Once you get through all the fiddling at the start, the result is exactly the same: it becomes increasingly expensive to emit carbon dioxide.

The permits do it through the market, as they gradually reduce in line with the emission reduction target. It's like the old game of musical chairs -- each year the government snatches away some of the permits. The direct tax would have become increasingly punitive.

Each has its own big loophole in terms of end-CO2 reductions.

Under the ETS, emitters could buy permits from overseas, while under the direct tax, if consumers were prepared to pay the price you could just keep emitting. But nothing, so to speak, can save Australians from an increasingly punitive tax. Whether it's called a carbon tax or just a scheme.

Now the government has committed to handing back all the money raised -- the budget described it as using "every cent it receives from the sale of Australian emission units to help households and businesses adjust and move Australia to a low-pollution economy".

Now how come the government establishing what is in effect a gigantic slush fund -- indeed, the mother of all slush funds -- doesn't make me cry, "Well that's all right then"?

Who couldn't be happy with the government taking $12 billion every year in a new tax on the explicit promise to hand it back. Oh, I'm sorry, not back, but to those it thinks need it, or where it will do the most good.

Especially when it delivers the promise with almost childishly silly language. Every cent?

Reducing emissions of (non-breathing) CO2 is only one part of the CPRS. By making carbon-based energy more expensive and gradually strangling the amount that can be produced, we will be market-directed into non-carbon or low-carbon energy sources.

These other forms of energy are not even remotely competitive with coal-fired power generation. We make them "competitive" by forcing up the price of coal-fired power, but we also help them even further by directly subsidising them.

And just to make sure, we will force consumers to buy their high-priced power by mandating that power companies source 20 per cent of their power from "alternative sources" by 2020 -- mandating either at state level or nationally, and in fact both.

Where will this power come from? We can play around, in somewhat different ways, with gas and solar, but in the main there is only one answer: wind.

Except there's one problem with wind -- it's useless.

In a brief but utterly devastating analysis, Andrew Miskelly and Tom Quirk tracked the power output of all the now quite substantial wind farms in South Australia, Victoria, NSW and Tasmania for every minute of June. The simply devastating conclusion: when the wind don't blow, it don't blow everywhere at the same time.

This utterly shreds the claim that if you build enough wind farms nationally the wind will be blowing somewhere. You have to keep fully equivalent coal power up and running, not just when the wind is not blowing, but all the time. So, we have a government that is proposing a massive new tax. It then proposes to waste most, if not all, of the money from it. Either by compensating people for higher costs, or by pouring it into "alternative" energy production that can't work.

All this, of course, is to absolutely no purpose. Even cutting our CO2 emissions to zero would make zero difference to global emissions.

Anyone who votes for the ETS next week -- or indeed any week -- is betraying both common sense and their basic duty to the national interest and every Australian.

A Muslim part-time model will be caned next week, becoming the first woman in Malaysia to be given the punishment under Islamic law, after she pleaded guilty to drinking beer, a prosecutor says.

An Islamic court in July ordered that Kartika Sari Dewi Shukarno, 32, be lashed six times with a rattan cane after she was caught drinking alcohol in a raid on a hotel night club in eastern Pahang state last year.

Prosecutor Saiful Idham Sahimi said on Wednesday Kartika would be the first woman to be caned under Islamic law after she chose not to appeal the sentence.

"This is the first case in Malaysia. ... It is a good punishment because under Islamic law a person who drinks commits a serious offence," he said.

On Tuesday, the court set a one-week period starting next Monday for the sentence to be carried out in a woman's prison, Saiful said. It is up to prison authorities to decide when to cane her during that period.

He said Kartika will remain in prison during that time and will be released "as soon as possible" after the caning is carried out.

Saiful said the rattan cane to be used on Kartika would be lighter than the one used on men, and its purpose was to "educate" rather than punish.

Muslims, who make up about two-thirds of Malaysia's 28 million people, are governed by Islamic courts in all civilian and Islamic matters. Most alcohol offenders are fined, but the law also provides for a three-year prison term and caning.

Non-Muslims are governed by civil courts, which also impose caning for offences such as rape and corruption. Women, children and men above 50 are exempt under civil law. Caning,
administered on the buttocks, breaks the skin and leaves permanent scars.

Kartika said earlier that she wanted authorities to cane her soon so that she can resume her life with her husband and children. Some politicians and women's rights activists have criticised the penalty as too harsh.

A woman and a man, both Muslims, were also arrested during a series of raids in Cherating, a beach town in Pahang state, on the night when Kartika was detained. Both were also sentenced to caning, but they have appealled.

Malaysian clubs and lounges typically serve alcohol and are not legally required to check if customers are Muslims before serving them.

 Hello, possum - but in a hospital unit?

THIS photograph was taken in the intensive care unit at the ailing Hornsby Ku-ring-gai Hospital. Staff found the brush-tailed possum sitting among open boxes of face masks, gloves and surgical sponges, its faeces scattered across the counter.

It was sent to the Herald only days after one of the state's most senior health bureaucrats denied claims the hospital had a big problem with possums, known to spread deadly golden staph and e.coli infections.

The photo was taken in 2005 but staff say possums have been plaguing the hospital for more than a decade and are removed weekly from wards and offices.

Desperate for help, they sent the picture to the Health Department at the time it was taken but the warning went unheeded. And one senior official used it as a point of laughter to show visitors to his office.

After the possum was found, staff in the intensive care unit locked up medical supplies but say maintenance workers regularly move the animals to boxes in trees within the grounds.

''The one in the intensive care unit is not an isolated case. It's par for the course around here,'' one doctor said.

Possums, which have a lifespan of 15 years, can carry deadly diseases easily transmitted to humans, including Lyme disease, leptospirosis, rickettsia and mycobacteriosis, which can cause abscesses, fistulas, headaches, vomiting and renal failure.

Their faeces can carry the gut parasite cryptosporidium and their urine can cause breathing problems for asthmatics.

Any animal in a hospital was a health risk but some, such as possums, were known to spread superbugs such as methicillin-resistant staphylococcus aureus, said an infectious diseases expert at Canberra Hospital, Peter Collignon. ''Allowing a wild animal, which scavenges far and wide, to contaminate gloves and surgical equipment is obviously a real problem.''

The chief executive of the Northern Sydney Central Coast Area Health Service, Matthew Daly, last week rejected allegations that the hospital had been neglected but did not deny continuing possum problems.

All reports of possum urine had been addressed, he said. ''Possum nests were in a derelict buildings and were subsequently removed,'' he said.

Up to six possums might live in the roof space of a family home, but more than 25 would probably be found in a hospital, said David Bennett, the owner of a possum removal service in Adelaide.

''You definitely wouldn't want them in a hospital. And unless you get an expert in, there is no way to keep them out. They are highly territorial and will immediately return to where they were.''

A spokeswoman for the area health service said yesterday the present management was not aware of the photo and an inspection of the hospital last week found no evidence of possums in wards or patient areas. ''All such reports are taken seriously and are dealt with at the time,'' she said.

The death of a 76-year-old woman from the Casino district of northern New South Wales has been referred to the Health Care Complaints Commission.

Details of the case were revealed in Lismore yesterday during a sitting of the special commission of inquiry into NSW public hospitals.

Elizabeth Lane says her mother was not properly fed or cared for by medical staff at the Lismore and Casino hospitals in the fortnight leading up to her death.

"It was a battle for two weeks. The medical staff, wouldn't listen to anything we were saying," she said.

"They looked at us as grieving daughters who could not accept their mother's death.

"I have read some of the other transcripts and there are people that have similar stories, but nothing quite as serious I believe as what happened to mum."

The North Coast Area Health Service is refusing to comment on specific cases, but says it welcomed the hearing and thanked everyone who gave evidence.

Bring it on, Labor, pull that trigger

When the Government's chief climate change science adviser, Professor Will Steffen, was asked to participate in an open debate this week for the benefit of senators about to vote on the Carbon Pollution Reduction Scheme Bill, he refused. Instead, he sent the independent senator Steve Fielding a letter belittling the scientist he was asked to debate.

Steffen, a research chemist with an interest in "Earth System science", accused Professor Bob Carter, a palaeoclimatologist, and other eminent scientists who have questioned the Government's scientific advice, of "flawed logic, misleading and inaccurate statements and confused and inconsistent analyses" not even worthy of university science students.

Steffen's reasons for his no-show? "By going there I would have given exactly the wrong impression, simply by being there, that there is a debate."

Steffen's attitude flies in the face of 1000 years of scientific method - of open inquiry, of encouraging the objective search for truth, sharing knowledge, testing hypotheses, welcoming challenges in order to demonstrate the robustness of your theories or help you develop new ones.

Something stinks in the climate science industry. The confected sense of urgency. The comic predictions by the United Nations that we have only "four months" to save the planet or that next year as many as 50 million climate refugees will be "displaced" by human-caused climate change. The fantasy that imposing a new tax on Australians will make any difference to the age-old phenomenon of climate change.

Here we had the Senate voting on Thursday on what both sides describe as one of the most significant pieces of legislation since Federation. Yet there has been little debate about the impact on jobs, household budgets, agriculture and industry, on electricity, gas and petrol prices, no consideration of nuclear energy, and scarce information about how we will do without the cheap baseload energy from coal-fired power stations which underpins Australia's high standard of living. Instead we have McCarthyist bullying of critics. At least Fielding, an engineer, is strong-minded enough to seek his own answers.

As it happened on Wednesday, the day before the vote, just 13 MPs and senators showed up to the debate he organised that had become a one-man talk by Carter. None were from the Government. Just 6 per cent of the Parliament could spare an hour to hear what the fuss was about.

What misgivings did Carter and three other scientists advising Fielding (the climatologist William Kininmonth, the former head of the Australian Bureau of Meteorology National Climate Centre; the hydro-climatologist Dr Stewart Franks; and the mathematician Dr David Evans, the former Australian Greenhouse Office carbon modeller) have about the science underpinning the Government's legislation?

Even if you reject the sceptical view, Australia produces just 1 per cent of the world's carbon dioxide emissions so if we were to shut down the country, the impact on global climate would still be negligible.

The Government is determined to resubmit its legislation to the Senate in November, under the threat of a double dissolution election, so that it is completed before the UN climate change conference in Copenhagen in December. Malcolm Turnbull is busy drafting amendments in an attempt to make the legislation palatable.

But the Coalition should embrace a double dissolution on climate change. Bring it on. Call the Government's bluff. It'll be their best chance of winning back office for years.

As Barnaby Joyce reminded everyone this week, by winning the "unwinnable" 1993 election, Paul Keating showed John Hewson how difficult it was to go to the Australian people with a new tax - which is what the emissions trading scheme is - an energy tax.

In Turnbull, the Coalition has the perfect man for the job of winning an election on an energy tax. He is enough of a genuine climate change alarmist to reassure green-minded voters, yet he is also a successful capitalist who knows the value of preserving a healthy economy.

Crafting complex deals, such as an ETS that might work, is his forte.

It's probably his only chance of being prime minister, so he will fight for all he's worth.

An early election will also force the Coalition to rally behind its leader, removing the unsettling effect of all that free speech they are currently engaging in. Plus it's just the kind of reckless gamble for which Turnbull is famed, and which he occasionally pulls off. It's right up his alley, if Utegate hasn't taken all his bottle.

You can bet money from industry would roll into Coalition coffers to help fight such an election, easily rivalling the union advertising largesse against Work Choices in the last poll.

And as Steve Fielding has found from the supportive emails and letters flooding his office, the public mood is turning resolutely against rash measures to stop climate change.

A Newspoll last month found 53 per cent of Australians want the Government to delay the ETS legislation until after Copenhagen, or not introduce it at all. Six per cent are uncommitted.

Only 41 per cent think Australia should pass the legislation before Copenhagen.

So what's the big hurry? In the Senate on Thursday after losing the vote, Penny Wong revealed the reason: "Because if we don't [bring the bill back in November], this nation goes to Copenhagen with no means to deliver on its targets.'' It's to give Kevin Rudd something to strut with on the global stage.
