A JUDGE has defended his decision to dismiss the conviction of a woman who refused to reveal her identity to a police
officer and made a complaint while wearing a burqa saying the Crown didn't satisfy two key elements of the case beyond
reasonable doubt.
Judge Clive Jefferies has just passed down his official reasons for granting Carnita Matthews her appeal against a
six-month jail sentence after being found guilty of knowingly making a false complaint against a police officer.
The original court decision had found Mrs Matthews falsely claimed a racist police officer had tried to lift her burqa when
she was pulled over for a random breath test last June. It was allegedly she then subsequently made a false complaint
about the officer.
But Judge Jefferies said that he could not be "satisfied beyond a reasonable doubt" that it was Mrs Matthews who made
the complaint about a police officer at Campbelltown Police Station. She was wearing a burqa at the time.

He said the prosecution had made their case based on the signature of Mrs Matthews matching that on her statutory
declaration, which he said couldn't be proved as absolutely true.
He also said that even if it were Mrs Matthews who made the complaint, he was not satisfied beyond reasonable doubt
that she made it "intentionally" knowing it to be false.
Mrs Matthews lawyers have made a costs application on her behalf, with the mother of seven not in court for the hearing.
Meanwhile, Daily Telegraph online readers have voted overwhelmingly in favour of the police with an overwhelming
majority voting that police should have the power to demand women remove a burqa in an online poll.
Almost 12,000 people had participated in the online poll at thetelegraph.com.au as at 4.30pm.
"Should police have the power to demand women remove a burqua" was the question posed, with 96.57 per cent,
representing 11,592 people, voting yes and 3.43 per cent, representing 412 people, voting no.
Several readers also took the opportunity to share their opinions on the issue in the story, written by Clemintine Cuneo,
who spent a day wearing a burqa in two Sydney suburbs.

I somehow feel this is a real worry when a person can walk around Lakemba, which last time I looked was in Australia,

Just want to let you know I am naturally blonde and have blue eyes and live in lakemba. people do not stop and stare nor
do they treat me differently. I have noticed many ladies with hijab or niqab that have blue eyes it's no big deal so I think
you worried about nothing. The old lady in Hornsby is a true reflection of a open minded human who accepts people even
though they are different. I am against the niqab
