Pulling pin on bomb terror plotters' trial

POLICE secretly created and exploded a "Mother of Satan" bomb to prove that Abdul Benbrika and his extremist followers had the materials to make the feared terrorist device.
They were able to show that terrorist followers of the radical Muslim cleric ordered or bought chemicals and specialist laboratory equipment to make a bomb capable of killing and injuring hundreds of
people.
The "Mother of Satan" bomb is the weapon of choice for terrorists around the world.
It was used in the 2005 London Tube and bus bombings which killed 52 people and injured more than 700, as well as many more terror attacks during the past decade.
But now officers from the joint taskforce that foiled the devastating plot - which had included a bomb attack at Sydney's nuclear reactor - must face the fact Benbrika and the other Melbourne cell members
will not face a jury.
The decision to permanently stay the charges in Victoria was made despite evidence in the trial of the NSW cell members that a terrorist attack of potentially mammoth proportions was imminent when
Benbrika and the Melbourne and Sydney cell members were arrested in co-ordinated swoops in 2005. NSW cell members Mohamed Elomar, 46, Abdul Rakib Hasan, 41, Khaled Cheikho, 38, Moustafa Cheikho,
33, and Mohammed Omar Jamal, 27, were subsequently convicted of conspiring to commit a terrorist act and jailed for 23 to 28 years.
In that trial, prosecutor Richard Maidment SC said the men sought large quantities of firearms, ammunition and chemicals that would have enabled them to build devices "capable of causing substantial
damage and loss of life".
"There are a number of utterances which suggest that the purpose of the organisation was to do something big, cause maximum damage, kill a thousand at the train station, football, whatever," he said.
The prosecution detailed the role of Benbrika and Aimen Joud in helping to order the lab equipment as evidence of a conspiracy to commit a terrorist act. It also provided an extensive chronology of the
many contacts between NSW and Melbourne terror cell members as more evidence of a joint conspiracy to commit a terrorist act.
Justice Terry Forrest's decision means Benbrika, Joud, Fadl Sayadi and Ahmed Raad will not face extra jail time on top of their sentences on the lesser terrorism charges they received in 2008.

THE nation faces a doomsday scenario of "hurricanes, storms and floods" unless action is taken on climate change, Greens MP Adam Bandt warned yesterday.
During yesterday's carbon tax debate, Mr Bandt said every person was threatened by climate change and "we are running out of time to prevent a catastrophe". "Ice caps are melting and the seas are rising," he said. "The hit to the Australian economy if we are not able to prevent runaway climate change is going to be enormous.
Mr Bandt warned jobs were threatened by climate change, saying that in Queensland 67,000 workers directly dependent on tourism and the Great Barrier Reef could be "turfed out of a job" if the reef is irreversibly damaged.
Speaking immediately after Mr Bandt, NSW Nationals MHR Mark Coulton said he had "never heard so much emotional claptrap".
"It seems to me that there's a lot of houses, a lot of buildings in the middle of Melbourne made out of concrete and it seems to me that while the good folk of Melbourne might have a desire to improve the environment, they don't appear to be doing too much of it themselves," Mr Coulton said.

AUSTRALIANS should not be scared of Sharia law because it is consistent with our own culture and values, the country's new Muslim leader says.
Dr Ibrahim Abu Mohamed yesterday said his goal as the Grand Mufti of Australia was "clarifying the misconceptions about our religion".
He said debate was clouded by misunderstanding and a focus on the more extreme punishments, such as a death penalty for Muslims who convert to another religion.
"It's not fair that you just look at one element out of a hundred elements in the Sharia law and make that element to be the most important thing," he said.
"We see a lot of the Australian culture and values are part of our Sharia law.
"Freedom is a Sharia law, respecting others is a Sharia law, justice is a Sharia law, tax and paying tax and fulfilling your obligations is also considered to be a Sharia law, respecting others and honouring others, that is all Sharia law," he said.
Dr Abu Mohamed insisted the Muslim community believed in a democratic system: "We are a democratic nation, and whatever the majority votes for is what goes."
He also hit out at talk that radical groups were drawing young Muslims to extremism and violence, saying "evilness always had followings".
"Extremism and radicalisation is not just in Islam and among Muslims, it does exist in all societies and all communities," he said.
He also said Australian troops in Afghanistan had the potential to inflame passions in the community, adding: "It is a nature of mankind that if there is any oppression upon any nation that our emotions start to move and react."

SENIOR police have called for tougher laws to protect children from perverts as a man avoided jail for a second time for trying to lure girls into his car.
Detectives called for a new law to deal specifically with offenders attempting to lure children into cars, saying existing laws were either not tough enough or were difficult to prosecute.
Hematullah Shafei, 19, received a seven-month suspended sentence after pleading guilty to intimidating a 15-year-old girl.
He was already on a good behaviour bond for committing the same offence just months earlier. Angry police said the only charges available to them in such cases were attempted kidnapping - which
requires proof of intent - or intimidation, which carried a lesser sentence.
A police source yesterday said a specific offence for attempting to lure a child into a vehicle, which carried tougher penalties than intimidation, would tighten the legislation.
A submission along those lines to NSW Police Legal Services division four years ago had not been acted on.
The Daily Telegraph in July revealed a frightening trend of "stranger danger" incidents, with a child approached every two days. Since then, another 11 child approaches have been reported to police.
Police yesterday revealed a 15-year-old boy was sexually assaulted after being grabbed by a man of African descent and forced into a toilet in a park in Sydney's west.
Senior officers yesterday revealed they were increasingly frustrated by the tough legal requirements needed to prove the more serious charge of attempted kidnapping.
Police Minister Michael Gallacher last night said he was "open to any suggestion by police if they identify a weakness" in existing laws.

"The welfare of children is paramount," he said.
A senior police officer said that offenders were usually charged with intimidation, however "what you are really dealing with here is attempted kidnapping - but it's impossible to prove because you can't
show intent".
Child-welfare group Bravehearts said sentences should protect children and reflect the seriousness of the crime. "We support tightening legislation or introducing a new law if current laws are inadequate," a
spokeswoman said.
Former assistant police commissioner Clive Small said people who tried to lure children into cars were usually serial offenders. He said the existing legislation was adequate but courts were failing to impose
suitable sentences.
Terrorism suspect acquitted after police officer shot during arrest

WHEN police were ready to arrest a man suspected of terrorism offences in November 2005, they sent in four local officers who had no knowledge of the investigation. They were given a description and
headed down the street while still on the phone to an officer from the terrorism squad.
What happened next has been subject to conflicting evidence but it ended with shots fired in the street in south western Sydney - one bullet hit the terrorism suspect in the neck, another grazed the hand of
one of the police officers.
The man, who cannot be named and is known only as BUSB, later admitted he was doing things to prepare for a terrorist act and was motivated by his religious beliefs.
The Herald can now report details of what happened during his arrest by four officers from Green Valley police station - two sergeants and two senior constables: one of those a crime prevention officer,
who usually spoke to community meetings, the other a traffic, warrants and summons officer.
When their car pulled up next to BUSB, the two junior officers had trouble getting out of the car: one could not open her car door because of a child safety lock, another struggled with her seat belt. None of
the officers was wearing body armour and only one appeared to have his firearm drawn. He later said he approached the man, saying: ''Mate, hang on a minute. Can we have a word?''
Within seconds several shots had been fired, the two men were hit and BUSB was arrested and charged. Earlier this year BUSB finally faced court on charges he had shot at one of the officers. Witnesses
gave conflicting evidence about what they remembered. BUSB maintained he had intended to fire a warning shot as he swung around, and had not realised an officer was behind him.
After a judge-alone trial, Judge Leonie Flannery acquitted him, ruling she could not be convinced that this had not been the case. Judge Flannery said she accepted that he had felt panicked and had been
feeling sick on the day.
''I am not satisfied that he put the Browning [firearm] in his pants because he was planning to shoot his arresting officers, but … his concern that he was going to be arrested and the climate of anti-Muslim
feeling in the community at the time, he believed that he might be harmed by police. I consider it is a reasonable possibility that he did not deliberately shoot in the direction of [the officer], intending to
hit him.''
BUSB was not charged with lesser firearms offences and was acquitted of all charges relating to the shooting.
Its now ok for Muslims to shoot Australian Police officers if they feel threatened by Police or feel you could be harmed by Police.

That was before September 11, 2001 - the moment he says the lives of Australians Muslims were forever changed by the actions of Osama bin Laden and al-Qaeda.
Mr El-Kadomi, 65, said hatred and discrimination towards Muslims had become a daily struggle his family.
"It really did change for us that day - like black and white," he said.
"It is hard to believe that something that happened on the other side of the world would end up affecting me and my family living in Australia."

Until the 9/11 attacks, Mr El-Kadomi said the community was more accepting of Muslims and he was never questioned about his religious views.
He also said people did not have an issue with women wearing a hijab, an issue that now troubled his daughters.
Mr El-Kadomi migrated to Australia from Palestine in 1971 and has raised five daughters and two sons with his wife Ameera in their Woodpark home in Sydney's south-west.
He has an Order of Australia medal for volunteer work and is founder and president of Parramatta Islamic Cultural Association, which aims to bridge the growing divide between Australian Muslims and people of other religions. Regardless of difficulties faced by Muslims, his daughter Linda Abbas said her family still felt privileged.
"No matter what people think, we're still happy to be living in Australia and we're grateful for all the opportunities we have in our lives because this is our home," she said.
“Opportunities” that your “Religion” has obliterated world wide wherever its evil shadow has fallen.
"We're law-abiding citizens and we're just trying to get on with our lives, just like every other Australian."
Mr El-Kadomi said beliefs of radical Islamic groups had nothing to do with the views of average Australian Muslims.
"It reflects badly on us," he said. "We are against extremism and we don't want anything to do with those views.
"Most Australian Muslims feel this way. Islam is peace and we believe it is wrong to kill anyone. We condemn acts of terrorism and follow Australian law - this is why we chose to live in this beautiful country."
But Mr El-Kadomi's daughter Rokaia Issa, 26, said she noticed a significant difference in the way people treated her after she began wearing a hijab two years ago.
She said wearing a hijab was more difficult when extremist Muslims made news headlines.
"Everytime I see something about Muslims on the news, I think 'Great, here we go - it's going to be hard for me to leave the house today'," she said. "People will pick fights with me in the middle of the street and give me dirty looks."

There recently was a death of a 98 year-old lady named Irena.
During WWII, Irena, got permission to work in the Warsaw ghetto, as a Plumbing/Sewer specialist.
She had an 'ulterior motive'.
She KNEW what the Nazi's plans were for the Jews (being German).
Irena smuggled infants out in the bottom of the tool box she carried and she carried in the back of her truck a burlap sack, (for larger kids).
She also had a dog in the back that she trained to bark when the Nazi soldiers let her in and out of the ghetto.
The soldiers of course wanted nothing to do with the dog and the barking covered the kids/infants noises.
During her time of doing this, she managed to smuggle out and save 2500 kids/infants.
She was caught, and the Nazi's broke both her legs, arms and beat her severely.
Irena kept a record of the names of all the kids she smuggled out and kept them in a glass jar, buried under a tree in her back yard.
After the war, she tried to locate any parents that may have survived it and reunited the family.
Most had been gassed. Those kids she helped got placed into foster family homes or adopted.
Last year Irena was up for the Nobel Peace Prize.
She was not selected.

Outrage at Indonesian court verdict

AN Indonesian court has jailed a minority sect member for six months for defending himself and others from a lynch mob which killed three of his friends earlier this year.
The sentence is the same or stiffer than those handed out last month to 12 Islamic extremists who led the mob in the February rampage, including a teenager who was filmed crushing one victim's head with a stone.
Human rights activists expressed outrage that one of those wounded by the mob should be jailed for longer than the leaders of the violence.
A panel of judges today found Ahmadiyah sect member Deden Sudjana guilty of ill-treatment and ignoring an order to evacuate the sect's property in Cikeusik, western Java, as the armed mob arrived.
"The defendant failed to act following the police order to evacuate," one of the judges told Serang district court.
"Video footage shows the defendant started punching a man with a black jacket."
Wearing a traditional batik shirt, the 48-year old defendant heard the sentence in stunned silence. Later he told AFP he was "disappointed" with the ruling.
"It's embarrassing. I'm purely a victim who has been criminalised in my own country," he told AFP.
"There was no police order to evacuate and I hit the man because he entered our house of worship, calling us infidels, and ordered people to kill us. Isn't it normal that I hit the man as an act of self-defence?"
Human Rights Watch deputy Asia director Elaine Pearson said: "The inconsistency between the trials of those who killed the Ahmadiyah and the trial of Deden Sudjana is appalling and smacks of injustice.
"Those responsible for the deaths of three Ahmadis got three to six months, and Sudjana also got six months - seems like the Ahmadiyah face blatant discrimination not just from Islamic militant mobs, but also from an Indonesian court."
One of the mob, members of Indonesia's majority Sunni sect, almost severed Sudjana's left hand with a machete during the February 6 onslaught, which pitted about 20 Ahmadiyah followers against around 1,500 enraged fanatics.
A secretly filmed video of the Cikeusik rampage sparked international concern when it appeared online within days of the attack.
The footage shows police fleeing the scene as the mob - armed with machetes and knives and shouting abuse at the "infidels" - launched their attack.
A handful of Ahmadiyah men tried to defend the property with stones and slingshots but were quickly overwhelmed.

THE recent case of the Muslim men accused of lashing another Muslim in his home is still to be decided by the courts but early reports suggest that Islam was once again hijacked and used as justification for criminal behaviour.
As lawyers and as Muslims, we find it reprehensible when Islamic jurisprudence is appropriated by backyard thugs whose actions show an utter contempt and arrogant disdain for the ethical, moral and reasonable principles that underlie Islamic theology.
The majority of Muslims are fed up with a minority who are content to manufacture ugly interpretations of Islam, which are far removed from the compassionate and just jurisprudential legacy we have inherited. Unfortunately, we live in a society where very few people make a distinction between the teachings of a faith and the myriad interpretations and distortions such teachings can produce.
We are also fed up with the media highlighting every criminal or stupid act by somebody who happens to be Muslim. There are more than 300,000 Muslims in Australia and while the vast majority are law-abiding, they stand accused alongside every Muslim who has a run-in with the law. The media attention is disproportionate, leaving the grossly unfair impression that the majority of Muslims are on the wrong side of the law.
The Muslim community is as diverse and eclectic as any community which broadly falls under a religious category and individual actions should not be extrapolated to a judgment about an entire faith community.
For every outrageous false claim made by a Muslim in the name of Islam, whether to justify misogyny, brutality or ideological divisions, there are countless Muslims - lay people, scholars, academics, community workers, activists, professionals, students - countering such ugliness.
We are not here to defend badly behaved Muslims. To such Muslims we say you should be held to account if necessary.
As Muslim women, as lawyers, as Australians, we have this message: there is no fundamental or intrinsic incompatibility between Islam and democracy.
We also say this: fears about the criminal code of sharia having a place in Australia are generated by sensationalist scaremongering. The criminal code is barely implemented in Muslim majority countries so any such debate is a moot point. That some might seek to justify their behaviour on the basis of sharia does not mean their actions are a true reflection of sharia law or that sharia law is coming to Australia. To be a good Muslim and a good Australian are one and the same thing. A life devoted to Islam's ethical and moral principles means a person will strive to have integrity, be law-abiding and embrace civic responsibilities.
Let us name criminal behaviour for what it is and not grace it with any religious labels.
