The Daily Telegraph understands customs officials will be given higher-level intelligence briefs in the wake of the failure that enabled convicted Sydney terrorist Khaled Sharrouf to slip out of the country last year using his brother’s passport.

The Daily Telegraph yesterday revealed Sharrouf, a convicted terrorist from south-western Sydney, is in Iraq with the militant group ISIL, which is trying to overthrow the Iraqi government.

Yesterday Prime Minister Tony Abbott said the border protection agencies were on high alert for up to 150 Australians believed to be fighting in either Syria or Iraq seeking to return to Australia and for associates trying to leave Australia to join them.

More than 50 passports had been cancelled, the Daily Telegraph revealed yesterday.

But a draft report of the Cousins’ review is believed to have uncovered a 9/11 “silo mentality” scenario in ­Australia — a reference to US intelligence failures uncovered after 9/11 — where vital intelligence which could have stopped Sharrouf at the gate was not shared.

Senior government sources revealed new intelligence-sharing arrangements were being rolled out to ­ensure customs officers at airport gates had greater ­access to data that could help them identify ­people on watch lists.

Mr Morrison said the Sharrouf incident had been “an early wake-up call” that had exposed weaknesses in the chain, which were now being addressed.

He said the government was also “rebuilding capacity” into the system after budget cuts to customs under the ­previous government of ­almost $700 million.

HYDE Park rioter Ahmed Elomar will spend at least two and a half years in jail for brutally bashing a police officer. The former champion boxer hit 
the officer with a pole during a confrontation on September 15, 2012, in Sydney’s angry Islamic march as part of a global protest against the anti-Islamic YouTube clip The Innocence of Muslims.

Judge Donna Woodburne yesterday said Elomar, the last of seven rioters to have their case finalised in court, had “agitated the crowd” as part of a group of “aggressive men”.

She fixed a total sentence of four years and eight months, and said only a full-time custodial sentence would match the crime.

The man, whose own mother described him as “not very intelligent”, became “overcome with the occasion” of the protests, the court heard.




Elomar’s barrister Greg James QC told the Sydney District Court during a ­hearing earlier this week that his client, a former champion boxer who competed in more than 20 professional bouts, was suffering an “impaired intellectual state”.

But Judge Woodburne said Elomar’s “cognitive ­impairment” had not ­“deprived him of the ability to appreciate it was wrong to bash a police officer in the head, as he did”.

Elomar smiled at the judge as the sentence hearing, which lasted almost two hours, finished.

The court heard the ­31- year-old married man “deliberately and forcefully hit a man who had done nothing more than get up that day and put his uniform on.”

Senior-Constable Jason Blanchard was struck with a pole and left bleeding from the head, with the court told the balaclava-clad Elomar “disappeared” into the almost 400-strong crowd after ­hitting the officer.




“(The officer) had no ­opportunity to see it coming,” Judge Woodburne said, ­adding police work is often “difficult, challenging and dangerous.

During the protest, ­Elomar carried a sign which read: “Our dead are in paradise, your dead are in hell.”


The charge of recklessly wounding a police officer and causing actual bodily harm, carries a maximum sentence of 14 years but Elomar ­received a 15 per cent ­discount for pleading guilty.

Judge Woodburne said the non-parole period would begin from September 2013, a year after the riots, meaning Elomar is eligible for release in March 2016.

His sentencing brings to an end more than 18 months of court hearings involving people charged over the riots.

Last year, protester ­Mohammed Issaka angered the court when he refused to stand for a magistrate. He later apologised.

THE man at the centre of the Hyde Park riots won't be sentenced until a brain scan can be performed on him, a court heard yesterday.

Ahmed Elomar, a former champion boxer, pleaded guilty to attacking a police officer with a pole during the September 2012 riots that were sparked by the controversial YouTube clip The Innocence of Muslims.

He is still waiting to be sentenced as his defence team, led by Greg James QC, have applied to have the case put off until a MRI scan can be done to reveal the extent of his brain injuries.

Mr James told the District Court he has been waiting for more than a year for the procedure, and that on the eve he was due to have it done he was moved between jails and not provided with the security to take him to the hospital.



"The day before a scheduled appointment (we were told) he had been moved to Parklea (prison) and for security reasons they weren't prepared to provide the escorts," Mr James said. "There's nothing to suggest he won't be moved (locations) again."

The court has been told the 30-year-old has an IQ between 58 and 60, (That's pretty high for a Muslim so I guess he is probably a Scientist, Doctor,Imam or 747 Captain ?) and suffered numerous head injuries during his boxing career.

The charge of recklessly wounding a police officer can carry a maximum sentence of 14 years but Elomar, the last of the rioters before the courts, will receive a discount for pleading guilty before trial.

The attack left Senior Constable Jason Blanchard bleeding from the head and Elomar's makeshift weapon bent out of shape.

Elomar has been the only one of the group to be held in custody since the riot despite numerous bids for bail. In one, made to the Supreme Court last year, his lawyers said he was suffering from early-onset dementia as a result of boxing injuries and this made him "susceptible to outside influence" but the prosecution blasted Elomar's claims he believed the protest would be "peaceful", arguing he had armed himself with the 2m pole and a full-face balaclava, which he was later seen wearing on television footage.

All of the other men charged after the riot have all been dealt with by the courts, with two jailed.

Mr James told the court his client has needed the MRI for months, and was prepared to privately cover the cost of the procedure, but had been knocked back on at least one occasion by Corrective Services. The scan will take one day, and is expected to be used by Elomar's counsel in preparing submissions for what sentence he should receive.

The court was also told during a hearing last year that Elomar suffered post-traumatic stress disorder after an incident in which he was kidnapped in Lebanon, but prosecutors said the evidence before the court did not support the claim.

Judge Donna Woodburne formally vacated the date for his sentencing hearing, with the case to be rescheduled once the scan is done.

A FORMER champion boxer accused of attacking a policeman during the Hyde Park Muslim riots has claimed other assault charges against him should be dismissed because he is "easily led" to commit crime because of blows to the head inflicted while boxing.

Ahmed Elomar, 30, the only man still in custody before facing trial over the September clashes, made the claim in Central Local Court yesterday as he was due to be sentenced over a brawl at a Bankstown juice bar on June 28, 2012. Elomar, from Denham Court, was charged with two counts of assault and one of affray, as well as two counts of driving while disqualified and one of possessing a mobile phone in his cell at Long Bay jail.

The court heard Elomar was among a group of 20 men - including an armed man - who assaulted Juicylicious juice bar owner Ali Issawi on June 28. He also threatened to burn down the juice bar, throwing a firecracker into the store the following day.

Elomar's lawyer Winston Terracini SC argued the charges should be dismissed under the Mental Health Act because Elomar was "easily led to take part in" criminal behaviour because of head injuries suffered during his teenage boxing career.

Mr Terracini said Elomar may have suffered "cognitive impairment" from boxing.

He needed to be taken to a "specialist teaching hospital" for MRI scans and "neurological" testing. Aside from any boxing injury, doctors should test to see if he had a "developmental disability", Mr Terracini said.

Mr Elomar may have "mild mental retardation" and post-traumatic stress disorder from "experiences some time ago in Lebanon", Mr Terracini said.

Magistrate Elizabeth Ryan dismissed Mr Terracini's application under the Mental Health Act and gave Elomar a one-year jail term for all the offences. He had been in jail since September last year awaiting trial on the riot charges, and so would be eligible for release from this sentence in September.

These latest charges of affray and assault were brought by the Counter-Terrorism Squad, which said in documents tendered to court that the crime was a religiously motivated attack by a group of Sunni Muslims.

It said Mr Issawi was targeted because he is a Shia Muslim and was believed to be a supporter of Syrian president Bashar Al-Assad.

"(Elomar) took hold of Ali Issawi by the throat and said 'Are you the owner of the shop?' We are going to burn it down," the documents said.

An unknown man who was with Elomar, and who had a gun tucked into his pants, said to Mr Issawi: "We are going to slaughter your necks, all of you, one at a time."

The documents state the group of 20 men who attacked the store emerged from the neighbouring business - the Al Risalah book store.

Bookstore owner Wisam Haddad asked Mr Issawi to prove he was not supporting Mr Al-Assad by donating money to Syria via the bookstore. Mr Issawi did not donate.

A CHAMPION boxer charged with beating an officer with a two-metre pole during last year's CBD riot thought the Muslim protests would be peaceful - but brought a balaclava along anyway.

Ahmed Elomar, 29, a two-time national boxing titleholder, was this morning refused bail in the Supreme Court on charges stemming from the violent scenes last September.




The father-of-three allegedly hit a constable with a flagpole during the angry uprising and also threw a "missile" at police, who he is then accused of attacking as they tried to arrest him.

The court was told that in an interview with a doctor after the incident, he claimed he only went to the protest because "it was meant to be peaceful".

Justice Robert Hulme said it was "very concerning" that Elomar had gone to the public gathering carrying a full-face balaclava - which he was later seen wearing.

"You wonder why he would do that if (the protest) was peaceful," he said.

Elomar was one of several men arrested following the protests, which drew up to 1000 participants in response to the posting of an anti-Islamic film on YouTube.

His lawyer Leah Rowan said the 29-year-old was suffering early-onset dementia as a result of numerous head injuries he had suffered and the condition left him "susceptible to outside influence".

"Without treatment … his condition is possibly going to deteriorate but it is not going to improve, that goes without saying," she said.

Ms Rowan said Elomar would live under the "watchful eye" of his mother - who was in court for the bail hearing - and with his wife and children in the family home.

But Justice Hulme refused him bail, noting Elomar had a history of breaching court orders and had even been charged again - with possessing a contraband mobile phone - while he was being held in custody.

Elomar appeared on a video-link from Long Bail jail sporting a beard and with his long hair drawn back in a ponytail for the court appearance.

He has been in custody since his arrest in September and has not entered a plea to the most serious charge of wounding an officer, 

which carries a maximum 14-year jail term.

Elomar was initially accused only of affray, but additional charges were laid after police reviewed video footage of the violent clashes during which bottles, rocks and pieces of timber were thrown.
He returns to court next week.

Police prosecutors argued Elomar was part of a group which police believed approached the US consulate "despite police attempts to disperse the crowd".

Police argued that Elomar had been involved in the riot which "gave rise to serious risk of public safety", the court heard.

ONE of the angry protesters featured on The Daily Telegraph's front page yesterday has walked into court right under the noses of police - and walked out again.

Wearing a white skullcap and sunglasses the man, who uses the name Abu Sayd, was among a group of supporters who attended court to support Ahmed Elomar. They appeared determined to act as a law unto themselves.

Sitting in Central Local Court as Elomar appeared via videolink, the group of at least 10 men laughed and waved at him during the bail application.

Elomar played with his beard and smiled back at his friends.

When the case returned after lunch the men didn't stand as Magistrate Clare Farnan came on to the bench, as is court protocol. After she said their friend would stay behind bars, the group stood up and shouted in Arabic .

Among media crews outside court were a number of police officers, who filmed the group as they walked in and out of the building during the day.

A police spokesman said police were still going through photographs and footage of Saturday's riot to determine exactly who had committed what offences.

"Then police will proceed to arrest and lay charges," the spokesman said.

Strike force McAlister, formed to investigate and identify those involved in the violent protest, appealed for members of the public with footage to come forward.

A FATHER of three charged with affray after a Sydney protest against an anti-Islam film turned violent has been refused bail.

Ahmed Elomar, a 29-year-old champion boxer, was one of six men charged over demonstrations in central Sydney on Saturday but the only one denied bail.
The other defendants will face court next month.

Elomar displayed little emotion as he appeared in Parramatta Bail Court via video link on Sunday wearing a T-shirt displaying the phrase "6th pillar".

He had been charged with affray and previously breaching bail for driving offences.

Defence lawyer Greg Scragg argued that his client had not taken part in alleged acts of throwing bottles at police during the Sydney protest, adding that a shoulder injury sustained from a skiing accident in August had been exacerbated by his arrest.

"He was caught up in circumstances that got out of hand," Mr Scragg said.

"His arrest was not justified. His arrest was done in circumstances of over-policing.

"He was taken to the ground. While he was on the ground he was kneed in the back, he was sprayed with pepper spray."

Magistrate Andrew George said Elomar had breached bail for driving offences and could not be trusted to obey his bail conditions.

"His disqualified driving offence raises concern that he's a person who holds contempt for orders made before the court," Mr George said.

Elomar's matter was adjourned until September 18 for a plea or mention at Central Local Court.

Police were called to Parramatta Bail Court after one of Elomar's supporters threatened cameramen from the Seven and Nine networks with violence.

The police were summoned by court authorities. Ten supporters left the courthouse without incident.

THE angry father of an Australian boxing champion arrested in Lebanon said yesterday his son had been brainwashed by a radical Muslim cleric who had been based in Liverpool.

Father-of-five Mamdouh Elomar attacked Sheik Feiz Mohammed yesterday, saying his hardline approach to Islam was wrong. He told The Sun-Herald that he urged his children to stay away from the cleric and the Global Islamic Youth Centre at Liverpool.

"Sheiks like Sheik Feiz ruin people," he said from his south-west Sydney home.

"He is not a sheik. He is brainwashing all these children. I know my religion so I can tell him when he is wrong, but these kids believe everything he says and think it's their religion. Someone needs to stop him.

"Today our kids are either at one extreme, partying or using drugs, or at another extreme with their religion. I don't teach my children to hate non-Muslims. I have taught them to love everyone."

Mr Elomar's son Ahmed, 24, nicknamed "Trigger" in the boxing community, was arrested in Lebanon last month with two other Australians, Ibrahim Sabouh and Mohammad Basal, and accused of having links to a terror cell in Lebanon. The men have not been charged.

He had been holidaying in Tripoli, Lebanon, for two weeks with his wife, Najat, 25, and two sons aged five and three before his arrest 11 days ago. The young father was considering moving to Lebanon after falling in love with the country last year.

The Sun-Herald understands that the featherweight champion, who is also the nephew of Sydney terror suspect Mohammad Ali Elomar, left his wife's family home at 10am with several friends and was arrested several hours later. His father said it was still unclear if he was arrested in a raid or on the street for not having identification.

"I know in my heart that my son has done nothing wrong," Mr Elomar said. "But if he has, I support the Lebanese Government and army. Ahmed is a good boy and cheeky, but he has a soft heart."

He said he had never heard of Ibrahim Sabouh, but thought his son might have known Mohammad Basal.

Ahmed, also known as "the Lebanese cowboy" because of his passion for Arabian horses, was devastated after his uncle was arrested in November 2005.

"It's disappointing because my uncle's not like that," he said in 2005. "It's upset the whole family."

Meanwhile, Sheik Feiz, who is working as a carpenter in Malaysia having earlier moved to Lebanon to escape constant ASIO surveillance, said through an associate last week that he was aware that he was wanted for questioning in Lebanon.

He said he was outraged by the allegations that he and his friends were linked to a terror cell.

"We should be entitled to say what we want so as long as we don't hurt anyone," he said through his associate.

"I know they [Lebanese authorities] want to talk to me, but I am not afraid because I haven't done anything. I will leave it in God's hands."

Sheik Feiz also said he had spoken to a Lebanese citizen captured with the Australians who witnessed one of the men being beaten.

He said he wanted the Australian Government to try harder to help its citizens.
