THE father of a 12-year-old child bride advised her to only have unprotected sex after he organised for her to wed an older man in an Islamic ceremony, court papers claim.

In a case that has shocked the nation, the girl’s 61-year-old Muslim convert father was charged with procuring his young daughter for sex and being an accessory before the fact to child sex after consenting to her “marrying” a 26-year-old man.

The girl’s “husband” was charged with 25 counts of sexual intercourse with a child after he wed the girl in the living room of her Hunter Region family home on January 12.

They had met at a mosque through the girl’s father, who police allege facilitated the ­relationship by allowing them to exchange phone numbers and letting them meet three times before they were wed.

The matter was yesterday mentioned in Burwood Local Court, where the man and the girl’s father were expected to enter a plea. However the magistrate was told the parties needed more time to negotiate with authorities.

For the first time, The Daily Telegraph was granted access to court papers filed in support of a successful AVO application brought by police against the girl’s father earlier this year. The court papers claim that on the day of the wedding her father gave the girl sexual advice.

“The advice was that she should not use the contraceptive pill nor should (her husband) wear a condom when they have sexual intercourse,” the papers said.

The pair stayed at a motel in Nelson Bay on their wedding night and had sex several times that night, police allege.

They then moved into a home in southwest Sydney but visited her father’s home five times before the 26-year-old Lebanese international student was arrested in February.

Her father even organised a queen size bed for the pair and on one occasion allegedly asked the girl if she needed to shower before morning prayers. The girl, now 13, told him she did need to shower.

“The (girl) indicated that this is how the defendant would have known that (they) were engaged in sexual intercourse,” the papers claim. It is a requirement of Islam to ­shower after sex and before commencing prayer, the girl allegedly told police.

Asked about having knowledge of his daughter having sex he said: “It’s not something I want to think about.”

When the father was first told by police that the husband had been arrested he allegedly said “but they are married”.

The AVO application claims the father told police his main concern was his daughter was not committing “a sin against god” by having sex outside marriage, and he consented to the marriage because she was beginning to “become excited around boys” and he didn’t want her to live “a sinful life”.

Asked if he would allow his eight-year-old daughter to marry at 12, police allege the man said he would, to prevent the “sin” of sex ­before marriage.

The girl and her sister are now in Department of Community Services care.

The imam who performed the ceremony, Muhammad Riaz Tasawar, 35, was fined $500 after pleading guilty to solemnising the marriage.

The 26-year-old man is being held at Villawood ­Detention Centre after his visa was cancelled and the father is in custody. They will face court again in June.

A SYDNEY mother stood in the dock holding her baby daughter as she became the first person in the state to be committed to stand trial for genital mutilation.

I have never heard of any Australian female Christian been spirited away to, say, the Vatican, for Genital Mutilation or Child Marriage rituals, happy to post reports detailing same here if any readers can supply same.  

The mother, who can’t be named, and retired nurse Kubra Magennis became the first people in NSW to stand trial for female genital mutilation, accused in Parramatta Local Court yesterday of performing the circumcision ritual on the mother’s daughters, aged 6 and 7. The pair face a maximum sentence of seven years in jail if convicted.

Sheik Shabbir Vaziri is charged with being an accessory to the circumcision ritual, allegedly telling locals to lie to police about the prevalence of female genital mutilation in the community.

The alleged circumcisions took place in Wollongong and Sydney some time between October 2010 and July 2012.

Defence lawyers unsuccessfully tried to argue the girls were not victims of female genital mutilation because they only received a nick to their clitoris.

Magistrate Roger Brown dismissed the submission, saying: “Any cut or nick to the clitoris will amount to mutilation.”

Dr Brown said female genital mutilation incited a strong response in the community.

“The nature of the allegations and the language used in the legislation can arouse strong passions,” he said.

Ms Magennis stood quietly as she was indicted to stand trial responding “No sir,” when Dr Brown asked if she had anything to say.

Outside of court she covered her face with her headscarf and swatted a journalist who approached for comment.

The mother whispered “No,” when Dr Brown asked her if she wished to provide any evidence in her defence.

The prosecution will largely rely on a police interview and a phone intercept between the mother and Ms Magennis.

Dr Brown said the oldest girl, known as C1 to protect her identity, had told police that, “she suffered a cut to her private parts”.

Her sister, C2, said she had been “hurt in the bottom”.

The girls’ father, a GP, and four other female relatives, who can’t be named to protect the girls, were also charged over the circumcision but their charges were dismissed at earlier court appearances.

A lawyer has been committed to stand trial with perverting the course of justice over the ritual circumcisions.

A date for the trial of Sheik Vaziri, Ms Magennis and the girls’ mother will be set on June 20.

ORGANISERS of a "Singaporean only" event could be found to have breached anti-
discrimination laws for turning away caucasians at the door.




The event, organised by the Overseas Singaporean Unit at the Royal Botanic Gardens over the weekend, was put on to celebrate Singapore Day - where people learn about the latest developments in their home country, listen to music performances and eat local food.

But the concert was yesterday embroiled in controversy after refusing to let non-Singaporeans through the doors to the free event.

On their website, the event is open exclusively for "Singaporeans and their families" only.

"Singapore Day aims to bring a slice of home to Singaporeans abroad so as to emotionally connect them back to Singapore," the website reads.

"It is also an event to galvanise the Singaporean community so that the sense of identity and belonging remain strong."

Irate people phoned 2GB talkback host Ben Fordham yesterday to complain that "white people" had been turned away in droves to the event.

The organisers did not return emails yesterday.

Anthony Sim, who attended the event and then blogged about it online, wrote that he had never seen so many Singaporeans congregating in the one place.

"It is quite heartwarming to know we are not alone. Everyone of us were on the same page," he wrote.

"There were no PRCs, India Indians, Bangla or Pinoys to annoy us."

Royal Botanic Gardens acting executive director Brett Summerell said the group responsible had hired out a large area for the day.

"My understanding was it was a private event and they paid a fee to hire out the area," he said.

"We had initial concerns over people not being let in but they had told us only people would only be turned away if it reached full capacity or they didn't pre-register online."

He said there was some "community concern" over the situation.

"Obviously it has created a bit of community concern and that is enough for me to review it and see if it's appropriate for the Botanic Gardens to be involved with them in the future," Mr Summerell said.

Men face ACT court on abduction, sexual assault charges

Two Indian nationals have been refused bail in the ACT Magistrates Court over allegations of abduction and sexual assault.

The two men, aged 31 and 20, appeared in court this morning charged with sexual assault, abduction, forcible confinement and acts of indecency.

Yesterday, police searched a property and seized several items.

The court was told the men lured the female victim into meeting them by using a social media phone app.

It is alleged one man made threats to the woman's son and said he would show the woman's husband their conversation on the app.

The court heard the woman was then taken to a Belconnen apartment, where she was repeatedly assaulted.

The men were refused bail on the basis that they could contact the victim and her family or interfere with the investigation.

They have been remanded in custody until October 22.

EXCLUSIVE: A CHILD bride forced to ­illegally wed at 14 has won a disturbing custody fight that shines rare light on arranged unions in suburban Australia.

Married off as a schoolgirl to a 21-year-old groom by her Muslim parents, the woman endured years of violence and abuse before walking out with their young daughter.

The Federal Circuit Court heard the bride's mum pushed her into the Islamic ceremony, telling the then-teen she'd get to attend theme parks and movies and eat lollies and ice- cream with her new husband.

But once the girl moved in to the man's outer-Sydney home she was locked inside, let out only to attend high school.

The court heard evidence her husband used to burn her homework, and made her drop out of classes entirely after about a year.

He also stopped her watching her favourite TV shows - Home and Away and Neighbours - instead screening a ­violent DVD showing soldiers taken hostage and blown up with grenades.

In a decision published last week, Judge Joe Harman ­described the man as "a most heinous, capricious and ­revolting misogynist".

The judge stressed that he accepted all of the wife's ­evidence, and expressed his concern that while the girl ­apparently reported her predicament to a teacher, mandatory reporting laws appeared not to have protected her.

In his decision the judge ­invited authorities, such as police, wishing to investigate the serious matters raised during the case to apply to the court to obtain material from the file.

Legal restrictions prevent the Herald Sun from identifying the parties.

The woman, now 24, can only be referred to by the pseudonym "Ms Elia", and the man, now 31, as "Mr Essey".

Ms Elia fell pregnant at age 17 and gave birth to a daughter, now 6, who was the subject of the custody proceedings.

Her affidavit included a claim Mr Essey had once threatened to marry off their young daughter when she turned 14.

The judge found that the couple's illegal marriage ceremony had taken place "with the full knowledge, if not connivance and co-operation, of her parents".

Ms Elia was subjected to ­violence, including being kicked, punched, stamped on and thrown into walls, and their daughter was also attacked, he found.

The court heard claims that Mr Essey was involved in ­regular criminal activity, ­including robberies and ­assaults and was a routine user, if not a dealer, of drugs.

The couple separated in early 2009. She has since found a new partner.

Ms Elia gave evidence she'd stopped speaking to her parents after her divorce.

"My father has said to me, 'So what if he raped you? So what if he bashed you?'

"He has also said, 'The only way you can come back to me is in a coffin to pray on you'."

Judge Harman ordered Ms Elia have sole ­responsibility for the child and that Mr Essey be restrained from having all contact with them.

THE gangland execution of drug-peddler and one-time murder suspect Khaled Kahwaji would have been solved much sooner if it had only happened somewhere else - anywhere else but Greenacre.



In this crime hive of south-western Sydney, witnesses curiously never speak up. It's the Greenacre code.

Kahwaji, 29, from Rhodes, was not a sophisticated or endearing criminal. Nor were his final moments, about 6.10pm on March 15, the stuff that romantic gangster stories are made of.

He was no match for the man who shot him, point blank, in his Mazda 3 at a house on Wilbur St.

His attackers knew he was coming because of his penchant for blaring loud music from his car speakers - they could hear him from blocks away.



A crucial person of interest, who police need to contact, was captured on a nearby CCTV camera a day earlier, shortly after Mr Kahwaji was involved in a fight on Wilbur St. His image is published here for the first time.

No one has been charged over the murder but enough people saw it, watching as two cars - a Toyota Corolla and a Hyundai hatchback - fled the scene.

Frustrated by witnesses refusing to co-operate, police have taken the unusual step of charging four people - including three women - who they believe are holding back crucial information.

They include Sabrine Chahine, 25, the registered owner of one car seen driving away after the murder. She was charged with refusing to say who was in the vehicle.

How public housing hid a cache of weapons

The second car was a rental, hired by her sister-in-law Sabayda Hawa, 30, who is now facing court on the same offence.

The others are Bilal Assoum, 36, and his former girlfriend, Lisa Salmon, 25. Detectives believe they saw everything, but they allegedly told investigators nothing, prompting both to be charged with concealing a serious offence.


While Sydney is all too familiar with premeditated, organised assassinations, Kahwaji's death was carried out with no effort by the killers to cover their tracks. They did not bother sourcing stolen getaway cars, obscuring the vehicles' license plates, covering their faces or using a silencer.

Kahwaji, a former rubbish collector, spent 10 months on remand over the 2010 murder of 26-year-old Saba Kairouz, a drug supplier shot dead as he played football at Greenacre's Roberts Park.

Dozens of people saw the murder but the case struggled in court. The witness box stayed empty.

Ironically, the Greenacre code that saved Kahwaji from prison now threatens to save his own killers from justice.

Eight months after his death, homicide detectives have mapped Kahwaji's final hours.

The day before he was killed he was seen carrying a gun around the time he was involved in a fight on Wilbur St. Police were called but he ran off when he saw the officers.

That night he slept at a brothel in Petersham, on Parramatta Rd, where he was a regular, arriving about 1am and getting evicted for abusing workers about 10 hours later.


Strung out on drugs and behaving erratically, he loitered at an associate's car workshop in Punchbowl, vandalising cars in the area before driving back to Wilbur St for reasons unknown.

After the murder, heavily armed tactical officers searched the homes of both the Hawa and Assoum families, usin loudspeakers to order the occupants to come outside. The Hawa's have since moved from the area.

Police say crime is so embedded in the Greenacre community psyche that criminals no longer care about possible witnesses - they know no one will speak.

"A murder such as this was carried out on the strong belief that the public would not be willing to assist the police and that is what has occurred," Detective Acting Superintendent Angelo Memmolo said, stressing the need for more people to come forward to help solve the murder.

"If people want to remain safe and don't want these shootings to continue, they need to come forward."

FIRST ON 7: Two of Sydney's notorious Skaf gang rapists looks set to be released on parole as early as tomorrow.

It is a prospect that many find appalling, but a victims' support group says it is better to have 29-year-old Mohamed Sanoussi out, but under control. 




Sanoussi has served 13 years for his role in the rapes which horrified Sydney on the eve of the Olympics.

His family is preparing for his release, which could be rubber stamped by the parole authority tomorrow.

"I think he should be given parole, e only has three years left on his sentence," the Victims of Crime Action League's Howard Brown said.

"He is going to require a hell of a lot of intensive supervision out in the community so he actually adapts to that."

Despite the prisons commissioner and the NSW Attorney General having previously opposed release, another rapist code-named H, could also go free tomorrow.

Earlier this year, another of the gang, Mahmoud Chami was released, while ringleader Bilal Skaff has another 20 years to serve.

If let out, Sanoussi will be under surveillance but could be free to return to one of the crime scenes, a park near his home.

Mr Brown added: "My concern is however that generally what happens with electronic tagging is that it only lasts three months."

"In this case it needs to last a minimum of 12 months so we can actually track where he's going."

Parole monitoring has come under fire since 7News revealed budget cuts to the unit which tracks violent offenders.

We asked the Attorney General to explain what supervision would be given to Sanoussi and others but he declined to comment.

Paul Lynch, the shadow Attorney General warned: "Last week we discovered that there were 200 positions lost in the surveillance system."

The community compliance and monitoring group. That is too many to allow proper and effective surveillance.

TONY Abbott has given his clearest time frame yet as to when he will be able to stop the boats should he be elected prime minister on September 7.

The opposition leader today said that by the 2016 election levels of boat arrivals would be back down to the last days of the Howard era when there were just three arrivals a year.

"That's my confidence," he said.

"Obviously idea is having zero boats but if we were able to get it down to three boats a year that would be a good thing."

Mr Abbott and his immigration spokesman Scott Morrison today unveiled more detail on the Coalition's border protection policy, as revealed by News Corp Australia today.

Under the Coalition plan, anyone who arrives in Australia illegally by boat will not get permanent residency, including more than 30,000 people already here.

Anyone arrivals "reasonably believed" to have destroyed their documentation would not be accepted.

A new assessment process, based on a UK model, would see faster removal of illegal arrivals.

Those found to be refugees would be granted temporary protection visas.

They would not be allowed to bring their family to Australia or convert the TPV to permanent residency.

The TPV would last three years after which holders would have to apply for another visa if it was not safe to return home.

They would be required to work for the dole.

The Coalition has also pledged to scrap a $58 million detention centre planned by Labor for Singleton in NSW.

 Tony Abbott channelled his predecessor and mentor, former prime minister John Howard by saying that Australians "were in charge of this country and we'll decide who comes here".

However the Opposition Leader could not rule out that asylum-seekers given refuge in Australia on temporary protection visas would not one day be permitted family reunions.

"I can't say what might happen in ten, twenty, thirty years time," Mr Abbott said.

"But what I can say is if you come here by boat you should never expect to get permanent residency.

"If you turn out not to be a refugee you will be in detention, that's where you'll be. If you are a refugee you will be on a temporary protection visa and you should expect to be on it indefinitely."

Mr Morrison said he was confident the new process would stand up to any future court challenges.

"This is a complicated and detailed area," Mr Morrison said.

"I am very confident that we will get this as right as it can be."

COALITION TO SCRAP ASYLUM APPEALS PROCESS

The removal of failed asylum seekers from Australia would be dramatically fast tracked under a hardline Coalition plan to send them packing in as little as three months.

And any of the 30,000 boat arrivals already in the country who have been found to be genuine refugees would denied a permanent visa.

The Coalition would also scrap plans for a detention centre at Singleton in the NSW Hunter Valley, where Labor plans to house more than 1000 people, and divert almost $60 million to build 2000 places it has promised for offshore processing in Nauru.

Opposition immigration spokesman Scott Morrison plans to adopt a hardline UK-style removal regime and to scrap the refugee review tribunal.

Asylum seekers would be "triaged" and those considered unlikely to be found to be refugees taken into detention, pending a review by up to two departmental case workers which could take as little as 28 days.

The removal process would be modelled on a scheme in the United Kingdom called Detained Fast Track, Mr Morrison said.

Those considered unlikely to be refugees would have their first assessment inside detention finished within 14 days and if it found against them they would then be able to access a 14 day review by another case worker.

The process would take no more than three months, a Coalition policy document shows.

A failed review would result in the government seeking travel documents in order for the person to be removed.

Failed refugees from countries, such as Iran which refuses to accept involuntary returns, would be left on the Christmas Island indefinitely.

"If there are issues with them being removed from the country we will send them to Christmas Island until they can be removed," Mr Morrison said.

PNG LOOKS AT ASYLUM SEEKER JOB SCHEME

Mr Morrison said the 30,000 asylum seekers who arrived before Prime Minister Kevin Rudd's announcement of the PNG Solution, and who are waiting in the community for their refugee claims to be processed, would be made to work for welfare payments.

They would all be moved onto temporary protection visas for up to three years and given work rights with a work for the dole style regime used in cases where they were unable to secure a job.

Asylum seekers could also be directed to regions where more work was available.

The temporary visas would prevent them bringing family to Australia and if they chose to leave they would be barred from returning, in a policy mirroring the Howard Government's temporary protection visas.

"They won't get a protection visa from us, they will be desperately hoping a Labor government gets elected," Mr Morrison said.

He said a Coalition government wanted to scrap the refugee review tribunal to help achieve its policy of "getting out of the country" people rejected as refugees under its single case worker review model.

Courts and tribunals have overturned up to 80 percent of departmental decisions to refuse a protection visa and cases have had to be re examined, Mr Morrison said.

"Our objective would be to get back to a single case officer decision and review system," he said.

In addition to other hard line measures, boat arrivals who came without paperwork would be rejected as refugees if it was found they had deliberately thrown their identification out.

About 90 per cent of people have arrived without paperwork at times under the current government.

The Coalition says the investment in a new detention centre for Singleton wasn't needed.

"Under the Coalition, offshore processing will be done on Nauru and PNG, not in Singleton," Mr Morrison said.

"That's why we will shut down Labor's plan to spend almost $60 million at Singleton and create that capacity where it's needed offshore.

"Kevin Rudd is making more room for people coming illegally on boats in Australia, at places like Singleton than he is offshore on PNG."

Mr Morrison said scrapping Singleton would allow the Coalition to fund plans it announced last month to house an extra 2000 asylum seekers in 

Nauru, including accommodating refugees in refurbished homes in the nation's slum district while Australia searched for third country resettlement options.

Almost 2500 asylum seekers have arrived in almost a month since Mr Rudd announced his PNG solution with only a few hundred sent to Manus Island after health checks so far.

Single adult men have been sent to the remote island while the government works to bring accommodation up to standard for families.

More than 50,000 people have arrived on boats under Labor.

NSW Counter Terrorism Squad says proceeds of crime in Australia are used to fund terrorism groups overseas

YOUNG Islamic extremists are committing crimes in Sydney to send money overseas to terrorist groups or to pay for their own trips to countries where they come in contact with extremists groups.

The head of the NSW Counter Terrorism Squad, Assistant Commissioner Peter Dein, said some of the proceeds of crimes had been funnelled into overseas terrorist organisations.

"It is well documented that in the past there has been a link between criminal activity and funding of terrorism," he said.

Assistant Commissioner Dein said he could not comment on individual cases but he conceded funds were, in some cases, finding "their way into the wrong hands".



The most pressing concern for the Counter Terrorism Squad and national intelligence services is young Australians being recruited and involved in terrorist camps overseas, especially in Syria, where it has been estimated more than 100 Australian dual nationals are suspected of fighting with the al-Nusra Front, al-Qaeda's affiliate in Syria.

"We know there are people going overseas and getting involved with insurgents," Assistant Commissioner Dein said. "How do they get there, who pays for their airfares, for spending money? Also what are they doing there, who are they associated with and what are they bringing back or doing when they get back?"

He said the squad was investigating these cases, following the money trails and examining any links with organisations or individuals in Sydney or the rest of Australia.

He said there was "not a lot of proven cases" but "what is of concern is the unknown".

He would not comment on individual cases as investigations were ongoing. However, a known extreme radical was involved in a theft and was caught on listening devices saying he wanted his portion of the robbery to go to the "cause".

In another case, debt collector and businessman Vasko Boskovski _ who was gunned down outside his home in Earlwood _ was a co-director in a company with convicted Punchbowl terrorist Khaled Sharrouf, who was jailed in 2005 for plotting to blow up the Lucas Heights nuclear reactor.

Assistant Commissioner Dein stressed the vast majority of money transfers going overseas were for valid reasons.

"But some of those funds do find their way into the wrong hands," he said.

But he said it was virtually impossible to estimate what percentage of the money was not for legitimate means.

Detectives have interviewed some of those who have returned from Syria and information is still being assessed.

"But it is only a small number because many have not returned," he said. "Obviously there are people we are concerned about and we keep a watch but it the unknown that is the biggest worry."

He said one of the biggest sources of information came from the Muslim community.

"They are vital to helping us keep abreast of what is happening in the community."

Counter Terrorism and Special Tactics command has just under 600 people at its disposal, including bomb response, rescue and negotiators.

Sri Lankan asylum seekers charged with indecent assault

TWO Sri Lankan asylum seekers have been charged with indecent assaults on two women and a girl at a Ricky Martin performance in Sydney last night.

The women aged 39 and 31 and a 14-year-old girl were in the crowd at Parramatta Westfield when they were allegedly attacked by the men who are on bridging visas and living in the community at Westmead.

Police swooped on the Sri Lankans, aged 47 and 20.

A police spokesman has confirmed the men were asylum seekers living in the community.

They were charged with indecent assault and common assault and granted conditional bail and will be required to report daily to Parramatta police station.

The men are due to appear in Parramatta Local Court on June 26.

It is the second time a Sri Lankan asylum seeker living in the community has allegedly committed indecent assault this year after a university student was allegedly set upon in her dorm.

No penalty for El-Amir Abdul Hamid El-Ayoubi over hitting police dog

HE admitted clubbing a police dog on the head with a stick during last year's Muslim riots.

But a Sydney magistrate yesterday threw out all charges against El-Amir Abdul Hamid El-Ayoubi, ruling he could have been acting in self-defence when he hit german shepherd Manchu.



He was accused of animal cruelty and spitting on the dog's handler, Senior-Constable Alex Seivl, during the September riot in Sydney's CBD.

Yesterday the Downing Centre Local Court was told the 20-year-old electrician was "afraid" after seeing dogs "let loose" on other protesters.

He grabbed a 20cm stick from the ground as rioters flung bottles and other missiles at police, who were standing in front of him with their dogs.

Senior-Constable Seivl said El-Ayoubi had spat on his chest from about 3m away - then came at him with the stick "screaming out in another language".




He said El-Ayoubi started beating Manchu with the stick before the dog grabbed his leg and the officer managed to tackle him to the ground.

Sen-Constable Seivl said El-Ayoubi looked "extremely angry" when he picked up the stick and started waving it at him before the attack.

El-Ayoubi denied ever spitting on the policeman but admitted he hit the dog twice on the head "out of raw emotion" after it grabbed him.

"No matter who it is, they're going to go for a strike to the head (to try) to get the canine off him," he told police.

Magistrate Elizabeth Ryan said she accepted El-Ayoubi had spat during the incident and said his wielding of the stick was "not the wisest course".

But she said there were no witnesses who backed Senior-Constable Seivl's claims of being hit with saliva and she was not convinced El-Ayoubi had lashed out before the dog bit him.

El-Ayoubi told police some young men involved in the riots had "testosterone coming out of the heads" but described himself as a "minor cripple" due to a knee reconstruction.

"The whole time I was just sitting back ... just being a part of the Islamic part of it, not the violent part of it," El-Ayoubi said.

Several men were arrested after the riots, which began as a protest against a YouTube clip posted overseas that mocked Islam.

Speaking after yesterday's decision, El-Ayoubi's lawyer Paul McGirr said his client was "very, very relieved" at the magistrate's ruling.

"He's a good boy and he's never been in trouble before," he said.

"His sister came to support him in court. He lost his father a few years ago and he's the man of the house.

"The decision meant a lot to them."
