A LAWYER involved in an alleged female genital mutilation case will face court today charged with two counts of perverting the course of justice.

Detectives from the Sex Crimes Squad and attached to Strike Force Longfield arrested the solicitor at his office in Sydney's inner west.

The strike force was set up to investigation claims two young girls had the procedure, also known as female circumcision, performed on them when they were aged six and seven.

Eight people remain before the court after being arrested by detectives last year. Findings are yet to be handed down in those cases

The lawyer has been charged with two counts of do act with intent to pervert the course of justice. He was granted conditional bail and will appear at Parramatta Local Court next week.

A SYDNEY sheik accused of involvement in the barbaric "genital circumcision" of sisters aged 6 and 7 is alleged to have told his Muslim community to lie about its widespread practice.

Police claim Sheik Shabbir Mohammedbhai Vaziri told members of the Dawoodi Bohra community at Auburn to lie to police when they questioned them over the mutilations.

Vaziri, 56, of Auburn, Helen Magennis, 68, a retired nurse of Campbelltown, and the children's parents have all been charged in relation to the alleged acts on the girls.

Police allege the procedures were carried out by Magennis.

A strike force of seven detectives from the NSW sex crimes unit was set up after an anonymous tip to the Department of Community Services several months ago.

It is the first time anyone has been charged with the offence in relation to children after legislation was passed in 1994.

A MAN has appeared in a Sydney court charged over the genital mutilation of two girls aged six and seven.

Family and Community Services Minister Pru Goward said she did not believe genital mutilation was rare in NSW.

Ms Goward said that female genital mutilation was an "abhorrent practice" and "a form of child abuse".

The two children are still in the care of their parents.

"They are good parents," NSW sex crimes unit head Detective Superintendent John Kerlatic said.

"It may seem a contradiction to say that when the parents are facing such serious charges. But they are not in any danger of any physical abuse."

The alleged genital mutilations occurred in the past 18 months at homes in Sydney.

Vaziri appeared in Burwood court yesterday on two counts of being an accessory after the fact to female genital mutilation, and hindering the police investigation.

Police allege Vaziri hindered the investigation by telling people to lie about the extent of female genital mutilation.

Magistrate Chris Longley said despite what many people would see as very serious charges, he was granting bail under strict conditions.

He said police opposed bail saying Vaziri was a flight risk.

Mr Longley ordered Vaziri surrender his passport and report to Auburn police daily and appear in Parramatta Local Court on September 26.

The parents were charged last Friday, granted bail and ordered to reappear in court on September 26.

Magennis is alleged to have carried out the procedure and was granted bail to reappear on October 3.

A DYING man who was shot in the head in Sydney's southwest yesterday was desperately asked by police to name his attacker using his last breaths.

The Sunday Telegraph has confirmed the deceased man is Khaled Kahwaji, who was charged with the murder of Saba Kairouz in August 2010.

Kahwaji was named on social media last night about 7pm though police asked it be withheld from publication for operational reasons.

Investigators are focusing their main line of inquiry to include a retaliation attack in relation to that murder, but are also investigating links with the shooting of a crime family matriarch on Auburn road at Auburn last Saturday.

The victim in that case, revealed by this newspaper earlier this week, was the aunt of Supermax inmate Bassam Hamzy, the founder of the organised crime group Brothers For Life.

Police later said they were bracing for an escalation in violence over the attack, which saw her shot four times in the legs at her front door.

Witnesses living on Wilbur St at Greenacre said they tried to help Kahwaji as he lay on the road just after being shot in the back of the head about 6pm last night.

The shooting happened outside a home which was later surrounded by police tactical operatives and the dog squad, who ordered the occupants, on loud speaker, to come outside.

After approximately one hour they then stormed the premises, though no arrests were made.

"We were trying to talk to him and just saying 'can you hear us'," a neighbour, who heard about five shots, told The Sunday Telegraph.

"The first thing police asked him was 'do you know who did this'."

Two search warrants were carried out by heavily armed officers later in the evening on the same street.

Police, the Homicide Squad and about seven riot squad officers have today returned to the scene, blocking off Wilbur st to door knock homes and conduct a line search for further evidence.

Police described the killing of Kahwaji, believed to be 30 years old, as a targeted attack.

He was shot a number of times, including the back of the head, while sitting in a Silver Mazda 3 on leafy Wilbur Lane about 6.15pm.

His body was found lying next to the car which had bullet holes in the driver's side door and about another three in the windscreen.

"This is not a random incident. This person has been targeted and it's certainly not something that is random," Bankstown police Superintendent Dave Eardley said.

"It's certainly an act that's quite vicious and callous."

In a shocking scene now regularly confronting residents of Sydney's western and southwestern suburbs, the street was shut down as more than 30 police scoured the area for evidence.

Forensic detectives and investigators from the Homicide Squad were also called in to assess the scene. Local residents returning from work were unable to enter their homes as the street was blocked off for about 100m.

Police cars and ambulance vans also clogged the street.

A group, believed to be members of the man's family, arrived on the scene soon after police arrived. There were hysterical scenes as several women in the group made their way towards the police barrier to view the body.

Police said it was too soon to say if the killing was related to motorcycle gangs but Supt Eardley said investigators were "not ruling anything out".

Yesterday's killing marks the 35th shooting in NSW this year - more than three a week - with 10 this month alone.

Some time on Friday Saleh Jamal will walk out of the South Coast Correctional Centre at Nowra as a free man.
Few on the street will recognise his bearded face or his name.
But the police who worked at Lakemba police station in November 1998 will remember, and the news of his release is likely to raise more than a few hackles.


In 1998 the notorious ''DK's Boys'' gang carried out a drive-by shooting on the Lakemba police station that left the building a mess of shattered glass, and much of Sydney in a state of uproar.

The shooting had five officers ducking for cover as 16 bullets from semi-automatic pistols passed through the station's foyer windows. Then police commissioner Peter Ryan pledged to track down those responsible and to make the streets of Sydney safe.
In May 2009 Jamal became the only person found guilty over the shooting as charges against the other men were dropped or not proven beyond reasonable doubt. He was later sentenced to a maximum of 12 years' jail for a range of charges including shooting with intent to cause grievous bodily harm.


Last Friday Jamal was quietly acquitted in the Downing Centre District Court after a 12-day retrial.
''Thank you, your honour, may God bless you and your family,'' a jubilant Jamal said.
The acquittal by Judge Steven Norrish coincided with the end of a nine-year jail sentence Jamal was serving for kneecapping a rival drug dealer at Greenacre in October 1998, a month before the Lakemba shooting.
''God willing I will be released next Friday,'' he told the court.
Jamal's release is a remarkable twist in what has been a dramatic and at times brutal and bloody story. For more than a decade the 37-year-old was one of the key members of DK's Boys, named after their leader Danny Karam, who ultimately perished in a hail of bullets from his own gang mates.
During the 1990s DK's Boys challenged Sydney's major players for a slice of the city's illegal drug market and, briefly, for a piece of the Kings Cross nightclub scene, with a brutal strategy that involved kneecappings and multiple murders.
In 2004, after being arrested and charged over the Lakemba shoot-out, Jamal fled to Lebanon with a false passport while on bail.
There he was subsequently arrested and jailed by the Lebanese government on charges of possessing weapons and explosives, planning acts that endangered state security, and possessing a false passport.
His five-year sentence for these crimes was later cut to two years after a Lebanese court ruled that only the passport conviction could be upheld.
In October 2006 he was extradited to Sydney where, in 2008, he was sentenced to nine years' jail for the 1998 kneecapping of a rival drug dealer at Greenacre.
The gang combusted in a fight with police on a White City tennis court in December 2008.
Last year, Jamal's conviction was quashed on appeal and a re-trial ordered.
Among the main reasons for the decision by the three-judge panel of the NSW Court of Criminal Appeal was that Jamal had not been permitted to accompany the jury when, as part of the trial, it visited the scene of the alleged crime.
In the Downing District Court this month Jamal faced the lesser charge of discharging a firearm in a public place.
He was found not guilty by Judge Norrish, hearing the matter without a jury.
He will hand down his reasons for the decision later this month.

A FORMER gang member has been jailed twelve years after a shooting attack on a Sydney police station.
Saleh Jamal will be behind bars at least until 2016 for his role in the attack on Lakemba police station in 1998.
Officers dived for their lives as a volley of bullets smashed into the station glass doors.

One hit a computer screen at head height.Judge Helen Morgan in the District Court today said it was a direct attack on one of the state’s law enforcement agencies.
“This attack was committed as an act of revenge against the police out of a misguided belief that they were unfairly targeting Lebanese,” she said.
The judge said they aimed to intimidate police and deter them from carrying out heir lawful duties.

He was a member of “DK’s Boys” an organised crime outfit headed by Danny Karam and was the get away driver when they targeted Lakemba police station in the night-time attack.
Judge Morgan rejected Jamal’s please for mercy on the grounds that it has taken so long for the case to come to trial.
She said that he was the architect of his own downfall.
His earlier trail in 2004, was aborted after he said he was ill.
He then fled to Lebanon on a false passport where he was jailed in Beirut after being convicted of terrorism offences.
The terrorism convictions was overturned on appeal and he was extradited in 2006 and in 2007 jailed in NSW for up to nine years for kidnapping arrival during a shootout at Greenacre in 1998.
His brother Mohammed Omar Jamal was convicted last year over a terrorist plot targeting Sydney Lucas Heights’ nuclear reactor.
Judge Morgan sentenced Jamal to a total of 12 years with a minimum of six and a half.
She said although he was the getaway driver he was as culpable as the gun who fired the shots into the police station.

TO his family, he was a "joker" idolised by his younger siblings and a "loving father" to his girlfriend's young daughter.

But to police, gunshot victim Faalau Pisu was an active member of the Comanchero Outlaw Motorcycle Gang.

The 23-year-old died in Liverpool hospital yesterday, hours after he was shot twice in the head while leaving a wedding reception in Sydney's southwest about 12.20am.

It is understood that before the shooting, the forklift driver and churchgoer had attended the wedding of a fellow Comanchero member named "Rok" at the Serbian National Defence Council function centre in Canley Vale. Police had monitored the function for several hours because of fears of possible violence.

Two other men - a 27-year-old gang associate and 25-year-old gang member - were also shot but survived.

Mr Pisu's death has "devastated" his extended family, who gathered yesterday at his parents' Mt Pritchard home to mourn. The family said Mr Pisu had been acting "strange" and appeared agitated in the days before the shooting.

"He was a tough kid but he would do anything for his family," Mr Pisu's adopted sister Faye Faimai Ale said.

"He was the joker of the family and all the little boys' idol. He was the guy who would pick them up and take them anywhere they want to go.

"My parents could never stay mad at him because he would turn everything into a joke. "When they went to lecture him, he'd always laugh and turn it into something funny."

Ms Ale said the amateur boxer was a "like a stepfather" to his girlfriend Linda Hinton's daughter Leati, 3, and split his time between her Smithfield home and his parents' house.

Ms Ale said her family - who were not aware of the wedding and denied Mr Pisu was a bikie - worried about her brother for several days before the attack.

He was last seen by the family about 1pm on Sunday when he borrowed his parents' car.

"We hadn't heard from him all weekend. He was acting a little strange though," Ms Ale said.

"He normally calls us and finds out what we were doing that weekend. Everything was short answers. So everyone had a bad feeling leading up to this."

Acting Chief Superintendent Arthur Katsogiannis yesterday said a "number" of the estimated 100 guests at the wedding were Comanchero members or associates.

It is understood Mr Pisu was a member of the Milperra chapter of the outlaw gang, which has had an ongoing feud with the Hells Angels Motorcycle Club.

The culprits, believed to have been wearing black balaclavas, fled in a blue ute after the triple shooting. Strike Force Raptor had monitored the event earlier in the night and pulled over some guests on their way to the wedding. However, the officers left the function centre several hours before the shootings.

Supt Katsogiannis said Strike Force Pindamir, comprising State Crime Command detectives and the Homicide Squad, was now investigating the incident.

Serbian National Defence Council function centre officials did not return calls yesterday.

Schools in west facing 'white flight'

PUBLIC schools across Sydney are experiencing a "white flight" of students.

Anglo-Australian parents are choosing to enrol their children in private schools over public because there are less children from migrant backgrounds, a new report by the University of Technology Sydney, based on data from the My School website, claims.

The western suburbs has the lowest number of Anglo-Australian students, accounting for as little as 2 per cent of enrolments in some schools.

Dr Christina Ho, a UTS researcher in multiculturalism, said public schools had become increasingly viewed as being "ghettoes" by many Anglo-Australian families.

"If you have a school that is 98 per cent or 97 per cent migrant-background kids, and hardly any background Anglo-Australians there, then that is a ghetto that doesn't reflect the diversity of the society we live in," Dr Ho said.

"Talk to enough parents about choosing schools for their kids, and sooner or later, you'll hear one express concern about the local public school having too many Asians, or Lebanese, or Muslims, or Aborigines.

"Minority groups change, but there is a growing creed among many Australians that a good school for their children is one where minorities are in the minority. They may not use the word [ghetto] publicly ... but it's the sentiment going on in their minds."

At Auburn Girls High, only 15 of the 782 students enrolled are Anglo-Australian despite there being a larger Anglo-Australian population living in the suburb of Auburn.

Anglo-Australians make up as little as 2 or 3 per cent of students at schools in Punchbowl, Canley Vale, Granville, Wiley Park, Bankstown, Belmore and Cabramatta. In Sydney's wealthier north shore, about 67 per cent of students at Chatswood High come from a non-English speaking background.

By comparison, migrant-background students at nearby St Ignatius College in Lane Cove make up just 8 per cent.Dr Ho said students had begun to jokingly play "spot the whitey" at public schools, with the "white flight" trend having accelerated over the past 20 years across Sydney.

Migrant-background students make up 37 per cent of Catholic school students and 22 per cent of independents.

 

I disagree with the term “white flight” I am sure there are also large numbers of non Anglo Australians who have also found the imposition of foreign Religious and Social practices and what they manifest to be unbearable and have also been driven out of their local state school .

White Flight should read Australian Flight, citizens who identify first second and last as Australians, loyal to Australian values and our Democratic Political and Judeo Christian Legal System.

Why would a Socialist Government , The Australian Labor Party do so much to destroy the living standards and safety of those it never stops telling us it knows what is best for them, their beloved “workers” the poor, their financiers the Union Members?

It is not unreasonable to ask of the Gillard Labor /Green Loon/Independent Coalition Minority Socialist Government, we know who is paying you but who are you working for?

Woman with pram robbed, assaulted

A woman pushing a child in a pram has been robbed at knifepoint and hit in the face in Sydney's south.

The 31-year-old woman was approached by two men while pushing a child in a pram along Toronto Parade, Sutherland, at about 5.15pm (AEDT) on Sunday.

One of the two men threatened her with a knife and demanded money.

The woman handed over a small amount of cash and was then hit in the face, which caused swelling, police say.

The men then ran from the scene.

Both men have been described as being of Mediterranean or Middle Eastern appearance with short dark hair, aged in their 20s, and of a slim build.

One of the men had a "rat's tail" in his hair, police said.

Police are calling on any member of the public with information about the assault to contact Crime Stoppers on 1800 333 000.

A 14-YEAR-OLD girl has been sexually assaulted by a limousine driver hired to ferry a group of teenage friends around Sydney after a late-night party at Bondi.

A Sydney court has heard the driver promised the girl she could ride to his next appointment to pick up rap star Kanye West and then plied her with alcohol.

After falling asleep on a back seat, the girl awoke to find the man, Mohamed Sabra, 34, of Bexley, fondling her breasts and performing oral sex on her, court documents allege.

Sabra, who owns Rockdale based Sabra Limousines, faced Sydney District Court on Friday after pleading guilty to sexually assaulting the girl in December 2008.

His victim, now 16, is the daughter of a prominent Sydney businessman, but neither can be named to protect her identity.

Agreed facts tendered at Sabra's sentencing submission hearing said the teen first met Sabra in November 2008 when a "family friend" arranged for him to drive her and a friend to the Rihanna-Chris Brown concert in Homebush.

On that occasion, the girl told Sabra she was 14-years-old, court documents said.

One month later she called his limo service and asked him to collect her and a group of friends from a party at Bondi where she had two alcoholic drinks.

In the limo, Sabra told the girl he "had an appointment to pick up singer Kanye West" who was touring Australia. The teen said she was a fan and the driver replied that she could "could go with him but there would not be enough room for her friends", court documents said.

She agreed and Sabra drove her to the Sydney CBD where she drank a Red Bull and vodka drink that he had poured in a champagne glass for her.

Sabra said he had a sore neck and asked the girl for a massage. She gave him a short massage and he started massaging her shoulders, court documents said. After waking during the alleged assault, the girl pushed Sabra away and said: "Why would you take advantage of me?", court documents said.

Sabra allegedly replied: "Why are you crying? If you didn't like it why didn't you stop me?"

The matter will return to court on January 28.

An HIV positive Sydney taxi driver who raped three female passengers had to be dragged out of court after being sentenced to 13 years in jail.

After the sentencing, Hassan Nagi, 38, stood holding a picture of his children and said he wanted to say something to the media: "I swear on my kids you are going to be shocked. Put the date down that I am going to be released. You will get a big shock."

Nagi, a father of three from Bexley, who pleaded a chronic case of "Don Juanism" in court, will be eligible for parole in October 2018.
Hassan Nagi ... pleaded for a lesser sentence.

His total prison term is for 13 years, 10 months and four days.

The victims, aged 31, 23 and 27, were raped after hailing Nagi's cab at night. Two of them were heavily intoxicated after a night out. Their identities have been suppressed.

Nagi's lawyer said he had been diagnosed with "a man's equivalent of nymphomania".

District Court Judge James Bennett said today that the offences were in the "serious" category.

He said that Nagi had abused a position of trust: people who do the right thing and do not drive home at night put trust in taxi drivers to get them safely to their destinations.

Justice Bennett also said there was an element of premeditation in his acts, because he had driven the women to out-of-the-way places.

Justice Bennett said he was not persuaded by a psychiatrist's diagnosis that Nagi was suffering from "Don Juanism".

"Implicit in that is the proposition that he was a master-seducer of women, blessed with charm and persuasive skills without the need to resort to the basic [methods that he adopted]," he said.

Outside court, Nagi's mother claimed that her son was innocent, healthy and that reports of his HIV status were untrue. She claimed the whole story would come out eventually.

The victims attended court for the sentence.

A relative of Nagi was heard to say in the direction of the victims: "Your lies are dripping off you."

One of the victims responded, "Read about it in the papers."

Nagi took an HIV test after pleading guilty in February last year to six counts of sexual assault.

When it came back positive, his lawyers told the victims.

In a decision published this month, the Court of Criminal Appeal said there was no evidence he had infected his victims or his family.

It is understood Nagi's family believes he contracted the virus from a dentist, despite his admission of frequent sex with prostitutes since the age of 20.

Justice Bennett confirmed that Nagi had undertaken an HIV test in 2003 that had come back negative, so he could have been infected any time since.

But he also said the risk of infection by a dentist was extremely low.

Nagi's lawyer had told the court that an article published in the Herald about his client was further evidence of the hardship he would inevitably face due to his HIV status and it should help to reduce his sentence.

The judge said while Nagi’s HIV status meant that the punishment he suffered would be greater, it was hard to quantify how much it should reduce his sentence.

Nagi's battle to keep his infected status a secret lasted 15 months and went all the way to the High Court.

The case pitted the principles of open justice against public health interests.

THE federal government is asking church groups for access to private properties to house asylum seekers spilling over from Christmas Island.
Immigration officials have spent recent weeks quietly phoning churches, asking them to nominate convents, monasteries and boarding houses where at
least 100 children and families might stay.
The government has already expanded Christmas Island detention centre and last month began moving people without visas to detention in Darwin and
Port Augusta.
Any extra accommodation is intended to supplement hotels and motels, such as the Palms International in Brisbane, which reportedly won a government
contract of more than $1 million to house asylum seekers.
The province leader of the Christian Brothers, Vince Duggan, confirmed the search for more accommodation on the mainland was under way. ''I know
approaches have been made to some bodies,'' the Brisbane cleric said. ''The request was made for 100 places.''
It is understood officials were making the calls as recently as last week, seeking places for families and unaccompanied minors, who sailed to Australia
without parents.
In Sydney, the Josephites' Sister Kathleen O'Connor was also aware of verbal requests from the Immigration Department. She said the government was
putting out feelers quietly to avoid further politicising refugee issues.
''It's done quietly,'' she said. ''[Asylum seekers have] just become this political football.''
More than 90 per cent of boat arrivals to Australia in 2009 were eventually found to be refugees. However, prolonged detention in faraway places
hampered their ability to settle into the community because of increased stress and exacerbated trauma, Sr O'Connor said.
According to the Immigration Department, efforts to quietly find more accommodation were part of ''prudent'' planning.
A spokesman reiterated the government policy pledging to keep children and families out of high-security detention centres.
''[The Department of Immigration and Citizenship] has been investigating a range of private properties around Australia - including some owned by
churches - as potential additional accommodation options for families and children should the need arise,'' he said.
''This may provide an alternative and more suitable accommodation option to the use of motels or serviced apartments.''
The Immigration Minister, Chris Evans, declined to comment.
The opposition said the government's failed policies had forced it into ''billeting'' asylum seekers. Its immigration spokesman, Scott Morrison, said boat
arrivals were unaffected by the freeze on refugee claims from Sri Lanka and Afghanistan.
''I have no doubt that Christian churches will respond generously, which is their nature,'' he said. ''But we have always had the view that offshore
processing should be universal and that is our preference.''
More than 120 unauthorised boats have arrived in Australia in the 30 months since the Rudd government came to power.
Mr Morrison said the Howard government first took children out of detention. There were facilities on Christmas Island to cater for families - but these
were now full.
