THE Muslim woman accused of lying about police trying to tear her burqa off has avoided jail - because her identity could not be proven.
Carnita Matthews, 47, from Woodbine, in Sydney's southwest, had been sentenced to six months in jail for making a deliberately false statement that a policeman tried to forcibly remove her burqa because he was a racist.
But judge Clive Jeffreys said yesterday he was not satisfied beyond reasonable doubt that it was Mrs Matthews who made the racism accusation because the person who complained to police was wearing a burqa at the time.
The absurdity of the law is that, to reach the level of proof of identity to make the case, Mrs Matthews would have been required to identify herself by lifting her burqa at the police station - what started the uproar in the first place.
More than a dozen Muslim supporters linked arms and began chanting "Allah Akbar" as they stormed out of Downing Centre Court with Mrs Matthews concealed behind them.
Tempers rose and they began jostling with police after several members of the group attacked cameramen.
It marked a stark difference from their behaviour minutes earlier, when they had quietly assembled outside the lifts for prayer shortly after the judge's decision.
Mrs Matthew's lawyer Stephen Hopper defended their actions saying: "They are obviously happy with the result and are expressing it in a way that is culturally appropriate to them."
Judge Jeffreys said yesterday that even if Mrs Matthews had made the complaint, he could not be sure she knew it was a "false" statement.
"I am not satisfied beyond reasonable doubt that she made the complaint," he said.
"Even if I was satisfied that she made the complaint, I am not satisfied beyond reasonable doubt that it was knowingly false."
Mrs Matthews made the claim in her court appearance last year, saying police could not prove it was her behind the burqa when the complaint was handed in to police. The local magistrate rejected it.
The case had lit up the religious debate when a magistrate found Mrs Matthews had deliberately made false complaints that Sergeant Paul Kearney was racist and had attempted to tear her burqa off her face when she declined to remove it on request.
She was pulled over for a random breath test last June, and accused Sgt Kearney of racism only after he booked her for failing to properly display her P-plates.
The incident was captured on a patrol car video camera and helped clear Sgt Kearney, prompting calls for all police cars to carry in-built cameras to avoid false claims.
"I've got my P-plates on my car ... there was nothing wrong with how they were displayed," Mrs Matthews says on the video.
"You look at me and see me wearing this and you couldn't handle it. All cops are racist."
She then threatens, "100 per cent", that she will take the matter to court and fight the charge.

SPARE me the pathetic preaching of the pro-Palestinian “peace activists” and their Western propagandists. It is now obvious that the goal of a number of those stupid enough to attempt to breach the Israeli blockade was martyrdom not the delivery of humanitarian aid to Gaza.
In the previous 24 hours, the wife of Ali Haydar Bengi, one of the nine killed when they confronted Israeli commandos boarding the MV Mavi Marmara, said he “constantly prayed to become a martyr”, according to a report in The Times of London. A friend of Bengi’s, Sabir Ceylan, confirmed this, saying that “before embarking on the journey, he said he desired to become a martyr”.
One of the late Mr Bengi’s shipmates aboard the Turkish-flagged ship was the one-armed Amin Abou Rashed. He was formerly a Palestinian national but is now the happy owner of a Dutch passport.
Mr Rashed is known to be a senior official in the Hamas terrorist organisation.
He is also listed on the official website of the Muslim Brotherhood, a movement for international Islamic domination as one of the organisers of the martyrs’ “Let’s Go to Gaza” cruise.
The so-called Free Gaza Movement, another of the organisers of this ill-fated cruise, has its roots in the International Solidarity Movement. This is yet another radical pro-Palestinian organisation that advocates what is euphemistically known as “direct action” in support of its destructive goals.
In 2003, the late American ISM activist Rachel Corrie - a foe of both Israel and her own homeland - applied a form of direct action when she misguidedly decided to kneel directly in front of an armoured Israeli bulldozer.
The bulldozer was engaged in searches for hidden tunnels at the time. Sadly for Corrie, she placed herself in a position where she could not be seen by the Caterpillar’s operator.
She is remembered today for the futility of her gesture.
Greta Berlin, the group’s 69-year-old co-founder and spokeswoman, agrees with Hamas that Israel has no right to exist.
However, she justifies her view as being part of a larger philosophy that is opposed to all national borders.
While there have been the usual raging anti-Israel demonstrations staged by Islamist sympathisers here and elsewhere, their case has been totally undermined by the videos now circulating.
These show activists aboard the Turkish-flagged Marmara chanting radical Islamic slogans before the clash. The circulation of those videos has done a great deal to take the sting out of this story for open-minded viewers.

Dr Abd Al-Fatah Shayyeq Naaman, a lecturer in Shariah law at a university in Yemen, also indicated that the Islamist violence was premeditated.
He told an interviewer: “The [Gaza] flotilla commander said: ‘We will not allow the Zionists to get near us and we will use resistance against them. They will resist with their fingernails. They are people who seek martyrdom for Allah, as much as they want to reach Gaza, but the first [martyrdom] is more desirable.” In Western cultures, there is a saying: “Be careful what you wish for.”
But when you belong to an insane Islamist death cult that worships martyrdom and preaches it to kindergarten-aged children, as the Palestinian Authority does through its bizarre television network, wishing for death is seen as a rewarding pursuit.
It was interesting to watch the angst-ridden faces of Western newsreaders conveying urgent updates on the fate of the useful idiots who lent their presence to this terrorist-sponsored cruise of the Mediterranean. It was dramatically apparent that these talking heads had no idea at all that the blockade on the importation of weapons and certain dual-use items into the Gaza Strip is imposed by both Israel and Egypt.
Among this concerned crowd, it doesn’t seem to have sunk in yet that there have been no reports of riots outside Egyptian embassies.
Nor do the public hand-wringers seem to understand that Israel has permitted about 2000 tonnes of humanitarian goods per day to flow into Gaza, along with access to medical care, power, and funds for the army of NGOs and the salaries of those working for the Palestinian Authority.
The flotilla was carrying the equivalent of five days’ supply of goods. In return, more than 1000 rockets, smuggled in through tunnels from Egypt, were launched from the Gaza Strip by Hamas at Israel where the targeted population is commonly given just a 45-second warning to seek shelter. The pro-Palestinian lobby is working overtime to tug at the heartstrings of the guilt-ridden middle classes to suggest that the blockade is creating critical shortages of food in Gaza. But just last week Financial Times reporter Tobias Buck wrote from Rafah that the volumes conveyed through tunnel smuggling are such that: “[The] prices of many smuggled goods have fallen in recent months, thanks to a supply glut that is on striking displays across the [Gaza] Strip.”
The tunnel smuggling, he wrote, had “become so efficient that shops all over Gaza are bursting with goods. Branded products such as Coca-Cola, Nescafe, Snickers [chocolate bars] and Heinz ketchup - long absent as a result of the Israeli blockade - are both cheap and widely available.”
No doubt the merchants were further outraged by the efforts of the “peace” flotilla to further undercut the prices in the souk. Before and during their provocative cruise, the Islamist flotilla organisers were offered the opportunity to offload their cargo in the port of Ashdod and hand it over to the UN for delivery to Gaza.
While this would have ensured the cargo reached its destination safely and expeditiously, it would not have helped those who were seeking martyrdom.
It would also have relieved them of the dozens of knives, Molotov cocktails, detonators, metal pipes, clubs, slingshots and stones, large hammers, wrenches, sharp metal objects, gas masks and bullet proof vests that were later found - hardly the kind of equipment usually associated with charity workers.
Peeling away the layers of disinformation disseminated by the Leftist-media, there seems little dispute that the Israeli and Egyptian blockade has been largely successful. The popularity of the leadership of Hamas has fallen behind that of the Palestinian Authority and Fatah in the West Bank.
It is impossible to see how Hamas can be regarded as anything but a barbaric terrorist organisation while it maintains its core belief that the independent state of Israel must be destroyed.
In Western culture, all loss of life is regrettable.
However, it is clear that the organisers of this week’s voyage to disaster are now intending to attempt to further provoke the Israelis with another futile exercise in blockade-running in the next day or so - and possibly earn more martyrs a speedy pathway to paradise.
While ever there exist cults that prefer death to life, there will be dupes willing to buy one-way tickets to oblivion.

NOTHING more to be said. Israeli soldiers kill at least nine peace activists trying to ship aid to a starving people. Or, as the front page of The Age screamed yesterday: "Israel kills boat protesters."
End of story. There are riots and protests in London, Paris, New York, Istanbul, Melbourne, Sydney, Canberra and throughout the Middle East.
The UN whacks Israel and calls for an emergency meeting of the Security Council. From Moscow to Washington, Israel stands utterly friendless. Dangerously alone.
What a coup for those pledged to destroy that tiny Jewish country. How discredited and defenceless Israel seems. Someone couldn't have scripted this any better.
Well, almost no better, because even the journalists most sympathetic to the activists on the ships intercepted by Israel couldn't help but refer, albeit grudgingly, to a couple of untidy details too obvious to ignore.
ABC host Jon Faine, for instance, described these victims of Zionist aggression as "humanitarian activists with a few knives". Er, with knives? Humanitarians? And a strident report in The Age, Australia's most left-wing daily, conceded that video of the Israeli soldiers being lowered on to the ships from helicopters did shows some of the "hundreds of politicians and protesters" on board had offered "signs of resistance".

Here are some of those "signs of the resistance" that report failed to detail.
You see the Israelis, at first brandishing just paint-ball guns, being grabbed as they landed, dragged to the ground, and beaten brutally with pipes and clubs.
On another clip, apparently shot by protesters, a soldier is stabbed in the back, and then in the front. Another soldier is beaten and thrown over the side.
Photographs show two Israeli soldiers, one of them shot, being carried off with serious wounds. This isn't what you'd normally expect from "peace protesters" or "humanitarian activists", even those armed merely "with a few knives".
These clues suggest the media - and many foolish politicians - have fallen for a brilliant propaganda coup.
Prime Minister Kevin Rudd also fell for it, saying he was "deeply concerned" and condemning "any use of violence under the sorts of circumstances we have seen".
His Foreign Affairs Minister, Steven Smith, likewise attacked Israel for a "terrible and shocking event" and demanded it hold an inquiry.
Not once did Rudd or Smith suggest an inquiry into who organised this trap in which Israel had fallen - or into those who now stand most to gain.
So who are we talking about? Here's another clue. The Israelis took over an "aid" flotilla trying to pierce the blockade which both Israel and Egypt have imposed on Gaza, controlled by the Islamist Hamas.
Only on one of six ships did the Israelis meet a resistance that clearly - and fatally - caught them by surprise. This was not on one of the ships manned by Western politicians, aid workers and other useful idiots brought along for camouflage.
It broke out instead on the Mavi Marmara, a ship supplied by a Turkish "humanitarian relief fund" known as IHH.
IHH may boast about its good works, but intelligence agencies warn that it is in fact tied to Islamist terrorists.
In 2001, Jean-Louis Bruguiere, the prominent French counter-terrorism magistrate, testified in the trial of the "Millennium bomber" that IHH had played "an important role" in the plot to blow up Los Angeles airport.
He said the charity was "a type of cover-up" to infiltrate mujahidin into combat, get forged documents and smuggle weapons.
In 2006, the Danish Institute for International Studies reported that Turkish security forces had raided the IHH's Istanbul bureau and found firearms, explosives and bomb-making instructions.
The Turkish investigators concluded this "charity" was sending jihadists to Bosnia, Chechnya and Afghanistan.
IHH is a supporter of Hamas, listed in many countries as a terrorist group. This time it planned something more effective than an explosion. It decided to destroy Israel's moral standing among its more fickle friends.
Its Mavi Marmara would now head a flotilla to break through the Israeli blockade of Gaza - or, rather, to provoke Israel into stopping it by force. IHH head Bulent Yildirim gloated that this would be seen as "a declaration of war" against all the countries which supplied the flotilla's passengers, which is why so many foreigners, and particularly sympathetic journalists such as the Sydney Morning Herald's Paul McGeough, were on board, having been recruited from Australia, Britain, the US and many other countries that IHH and its allies hoped could be turned into enemies of Israel.
It was obvious Israel would act. It had to. To relax the blockade once would be to open a corridor to yet more ships, giving Gaza another conduit for the smuggling of jihadists and militarily useful supplies.
Oh, and ignore soothing claims now that Hamas, which runs Gaza, should actually be negotiated with, rather than blockaded. Hamas fires rockets at Israel and has a charter which calls for the destruction of Israel, declaring "there is no solution for the Palestinian question except through jihad."
Indeed, jihad was also the spirit on the Mavi Marmara as it sailed for Gaza.
Those on board refused offers by Israel that they dock at an Israeli port so their aid could be checked and forwarded to Gaza. They rejected warnings to turn back. They prepared instead for confrontation. Arab television showed a woman exulting: "We await one of two good things - to achieve martyrdom or reach the shore of Gaza."
She said: "These are people who wish to be martyred for the sake of Allah. As much as they want to reach Gaza, the other option is more desirable to them."
They got just what they wanted, then, as did Hamas and its chief backer, Iran.
Iran, needing a distraction from its nuclear program, pumped out instant YouTube footage of this Israeli "atrocity".
Meanwhile Hamas spokesman Samil Abu Zuhri called for a global "intifada": "We call on all Arabs and Muslims to rise up in front of Zionist embassies across the world."
And in capital cities around Australia we yesterday saw the new front open as angry demonstrators took the streets.
So what, you may scoff. A few of the usual hotheads. But see this time how many of our politicians, journalists and "thinkers" are on the wrong side of this front.

The leader of a Melbourne-based terrorist cell has been sentenced to 15 years' jail.
Abdul Nacer Benbrika, 48, of Dallas, was sentenced to a non-parole period of 12 years. He has already been in custody for 1184 days.
Justice Bernard Bongiorno in the Supreme Court said a terrorist organisation led by Benbrika had been dedicated to the destruction of non-believers but the group had not planned specific attacks despite the evidence of a key prosecution witness.
Benbrika became the first Australian to be convicted of leading a terrorist group last September, following the country's biggest terrorism trial that lasted seven months and cost tens of millions of dollars.
The father-of-seven faced a maximum 25 years' prison for directing the terrorist group that the jury heard had discussed attacking Melbourne's Crown Casino and bombing the MCG.
Benbrika was also convicted of possessing a compact disc connected to the preparation of a terrorist act.
But in sentencing Benbrika and six of his followers today, Justice Bongiorno said he did not accept the evidence of Izzydeen Atik, who claimed Benbrika told him the terror cell had planned to target the casino on Grand Prix weekend in 2006 and the MCG on grand final day in 2005 and the 2006 NAB Cup.
Atik had been a member of the group before pleading guilty to belonging to a terrorist organisation in July 2007 and was jailed for just over four years.
Justice Bongiorno said Atik was a liar and a cheat who had defrauded the social security system while living in a luxury townhouse and employing a butler.
At the time, he was earning thousands of dollars a month from a credit card scam, the court heard.
But Justice Bongiorno said the terror group had still posed a "significant threat" and might have carried out a terrorist attack if not stopped.
He said the men had committed serious crimes but not as serious as if Atik's evidence had been accepted.
Benbrika used warped teachings of Islam to recruit his young followers and encourage them to wage violent jihad against "non-believers" in Australia.
Justice Bongiorno said that, although the word jihad had many meanings in Islam, Benbrika used the term only to mean a violent attack by his group to advance the Islamic cause.
He said Benbrika had admired Osama bin Laden and believed that killing people and destroying buildings was justified as it would help pressure the Australian Government into withdrawing troops from Iraq and leaving the American alliance.
The court heard Benbrika had told one of his followers, Abdullah Merhi, not just to kill a few people but to "do a big thing".
Merhi had responded "like Spain", in reference to terrorist attacks on Madrid, Justice Bongiorno said.
In May 2004, a Victorian undercover police officer posing as a Turkish Muslim man had infiltrated the group.
Five months later, he offered to show Benbrika how to make explosives and took Benbrika to a remote bush location north of Melbourne where he detonated a device.
Benbrika asked how much explosive would be needed to blow up buildings and homes but did not ask the undercover agent to get him any of the bomb-making ingredients or tell any of the other members of the group about the demonstration.
Six of Benbrika's followers also received prison terms.
Aimen Joud, 24, of Hoppers Crossing, has been jailed for a minimum of 7½ years.
Abdullah Merhi, 23, of Fawkner, must serve a minimum of four years in prison.
Ahmed Raad, 25, Fawkner, will be required to serve a minimum of 7½ years.
Amer Haddara, 29, of Yarraville, was sentenced to a minimum of 4½ years.
Fadl Sayadi, 29, of Coburg, was sentenced to a minimum of six years' prison.
Ezzit Raad, 27, from Preston, must serve five years and nine months.
Justice Bongiorno said that, under terrorism laws, those charged with offences had criminal liability earlier than in other criminal cases.
Remy van de Wiel, QC, had argued at presentence hearings that Benbrika's sentence should be tempered because he suffered from depression and an undiagnosed medical condition which caused him to have "embarrassing involuntary movements" and would make his prison time more stressful.
He said Benbrika had not properly led the group, which had never grown beyond an "embryonic terrorist organisation".
But Justice Bongiorno said that, by its existence and nature, the organisation had fostered in its members the desire to commit terrorist activities.
He said the evidence suggested that Benbrika was still committed to violent jihad, had shown no contrition for his offences and had talked about continuing the group's activities behind bars if its members were jailed.
Benbrika was arrested in November 2005.

IT was a blueprint for terror. Seized by police from the home of one of the alleged ringleaders of the Benbrika Muslim terror ring, it was al-Qa'ida's chilling step-by-step guide on how to build a terrorist cell, avoid detection, conduct training, obtain weapons, select targets and launch attacks.
It was one of at least two such instruction manuals that, according to authorities, were used by self-proclaimed Melbourne cleric Abdul Nacer Benbrika, 48, to set up and run his secret group.
One, which was also found in the hands of an al-Qa'ida member by British police, begins by setting down the three main principles essential to setting up a group: a commander and a leadership advisory council; individual members or "soldiers"; and a clearly defined strategy.
The primary mission of the group should be "the overthrow of the godless regimes and their replacement with an Islamic regime", the manual says.
Other missions are listed as "assassinating enemy personnel as well as foreign tourists" and "blasting and destroying the places of amusement, immorality and sin".
The manual was seized during a police raid on one of Benbrika's trusted lieutenants in June 2005. He was one of six of the fanatical religious leader's followers convicted alongside Benbrika this week of belonging to a terrorist organisation.
The manual, originally in Arabic when found on a computer by British police, had been translated into English for use in a later terrorist trial in the US. It was the English language version that was found in the Melbourne raid and later presented to the jury as a prosecution exhibit.
According to the manual, terror cell recruits had to be Muslims able to follow strict orders and "willing to do the work and undergo martyrdom for the purpose of establishing the religion of majestic Allah on Earth".
They also had to be able to "endure psychological trauma, such as those involving bloodshed, murder, arrest, imprisonment and reverse psychological traumas such as killing one or all of his organisation's comrades".
Operational funds had to be gathered, but kept hidden in scattered locations to avoid their being seized by authorities.
There were detailed instructions about maintaining security within the group, including using secret identification signals, selecting safe houses and avoiding the scrutiny of law enforcement agencies.
Paramilitary training of recruits should be done secretly in groups of no more than 10 at remote locations and care had to be taken when buying weapons to avoid being seen or ripped off.
They were lessons that Benbrika, who this week became the first person in Australia to be convicted of leading a terrorist organisation, apparently learned well.
The seven-month Victorian Supreme Court trial was told the self-proclaimed sheik, also known as Abu Bakr, chose three of the group to form his trusted advisory council to help lead the group, as laid out in the manual.
Fadl Sayadi, 28, was the group's security and intelligence officer; Ahmed Raad, 25, was the treasurer; and Aimen Joud, 23, was Benbrika's trusted adviser, the jury was told.
Funds to finance the group were raised through stealing cars to strip them for parts, and credit card fraud committed against non-Muslims, under a special religious ruling, or fatwa, issued by Benbrika.
One alleged training camp was held on a remote property in outback NSW in March 2005.
Joud, Sayadi and Raad were kept under surveillance by police as they drove to the remote campsite. A Belgian .308 rifle that forensic tests showed had been used at the site during the target shooting was later seized from another man associated with the Benbrika cell.
The group's mission, according to senior Crown prosecutor Richard Maidment SC, was to wage violent jihad on Australian soil to force the Howard government into withdrawing troops from Iraq and Afghanistan.
According to one Crown witness, potential targets included the AFL grand final at the crowded MCG in 2005 or Melbourne's Crown casino during Grand Prix weekend in 2006.
Among the group's recruits were Abdullah Merhi, 23, who had allegedly offered himself to Benbrika as a suicide bomber, and Haddara, who told police after his arrest he wished to become a mujaheddin and wage jihad as an Islamic holy warrior.
Members of Benbrika's group were taught that they would be regarded as Islamic martyrs if they died, and were instructed on how to be an "effective member of the organisation so that they were capable of going into a situation where a terrorist act was to be actually perpetrated".
The one piece of advice the Benbrika cell ignored from the terror manual, and which would prove to be their undoing, involved how they communicated.
The manual warns that modern communications, such as mobile telephones, were a "double-edged sword". "It can be to our advantage if we use it well and it can be a knife dug in our back if we do not consider and take the necessary security measures," the manual says.
For Benbrika and his followers, their undisciplined use of telephones became their knife in theback.
Despite the fact members rightly suspected that their mobiles, which included many held under false names, were being bugged, they kept talking.
Mobile calls between group members were among 482 covert recordings played to the jury as part of the prosecution case in thetrial.
One of the agents close to Operation Pendennis - the joint ASIO, Victoria Police and Australian Federal Police taskforce that spent 16 months between July 2004 and November 2005 targeting the Benbrika group - described the home-grown terror cell as "the real deal".
Some officers are now concerned that potential new Muslim terror threats could prove harder to combat because of the details revealed during the marathon trial of tactics and techniques used by the Pendennis team.
The trial was told how the taskforce threw a massive electronic and physical surveillance net around Benbrika and his followers: 16,400 hours of recordings from bugs in homes and vehicles, 98,000 telephone intercepts and 402 shifts by surveillance teams.
The trial was given detailed evidence about the techniques used by an undercover counter-terrorism agent, identified only as SIO39, to infiltrate the Benbrika group. The man, using the name Ahmet Sonmez, posed as the son of a separated Turkish-Australian couple who had initially grown up in Turkey with his Muslim father before moving to Tasmania to live with his Australian mother.
It meant that members of the Melbourne group would have had trouble attempting to verify his family background.
SIO39 went to great lengths to make himself as attractive a recruit as possible to Benbrika.
He told the sheik he had easy and cheap access to ammonium nitrate fertiliser and had learned how to turn it into an explosive mixture while working on farms in Tasmania.
He also claimed to have made surplus money from selling inherited shares, which he offered to give to Benbrika. And he repeatedly talked about how it was time to wage violent jihad in Australia.
Benbrika was apparently fooled but some of the other terror cell members were not so confident, believing SIO39 too good to be true.
As one of them pointed out, he didn't even want to argue with other members during their frequent heated discussions about religion. And in a group that was constantly squabbling, simple agreement was enough to cast suspicion.

KEVIN Rudd has left open the possibility of Australia taking former inmates from the prison camp at Guantanamo Bay, but warned that any US request for an inmate to come would be subject to legal criteria and assessed on a case-by-case basis.
As the Greens warned the Prime Minister he faced a political backlash if he accepted detainees held in the US military jail at Guantanamo Bay in Cuba, a spokesman for Mr Rudd confirmed that US authorities had approached Australia and other countries about resettling the detainees.
"Australia, along with a number of other countries, has been approached to consider resettling detainees from Guantanamo Bay," the Prime Minister's spokesman said.

"Any determination for an individual to come to Australia would be made on a case-by-case basis. All persons accepted to come to Australia would have to meet Australia's strict legal requirements and go through the normal and extremely rigorous assessment processes."
The Australian reported yesterday that the US State Department had over the past 12 months cabled more than 100 countries seeking help to clear out Guantanamo Bay.
The incoming administration of Barack Obama, which plans to shut the facility within two years, is expecting help in resettling more than 250 detainees still held at Guantanamo Bay.
About 60 detainees have been cleared for release by US authorities but are unable to return to their homelands because they fear retribution.
Greens senator Rachel Siewert told The Weekend Australian Guantanamo Bay was a creation of the US Government and was therefore Washington's problem. She said the Prime Minister should refuse to take any detainees.
"It's something they should be dealing with on home soil," she said. "We understand some can't go back to their homelands, but in those instances the US Government should be helping them within America."
Guantanamo Bay was opened in 2002 as a way of holding detainees caught in the war on terror beyond the reach of the US courts, where civilian rules for detention would apply.
Some European countries, keen to improve relations with the US, are understood to have said they are willing to help with resettling the detainees.
Germany and Portugal have acknowledged they were considering taking detainees, but The Netherlands has ruled out taking any, arguing it is the responsibility of the country that imprisoned them.
While some inmates are al-Qa'ida linchpins such 9/11 plotter Khalid Sheikh Mohammed, others have been held for years without charge or trial and without presenting any threat to the US or the West.
Australian David Hicks was held there for five years before being convicted last year of providing material support for terrorism. He was returned to Australia to serve nine months' jail before being released and placed under a control order, which expired last weekend.
Another Australian, Mamdouh Habib, was released from Guantanamo Bay without charge in 2005.
Mr Obama & Mr Rudd, Sydney already has, in the south west, entire suburbs occupied (Sydney's "occupied territories") by Islamic terrorists their sympathysers and facilitators, Islamic gang rapists,Islamic murderers and bash artists,Islamic drug distribution and car rebirthing networks.

The federal opposition leader, Malcolm Turnbull should make this latest planed attack upon Australia by the Australian Labor Party (ALP) as the line in the sand,and say loud and clear now that the ALP's policy of going soft on terrorists,terrorism and illegal entrants will be totally demolished upon the election of a Trunbull led federal Liberal Government.
