A JUDGE has defended his decision to dismiss the conviction of a woman who refused to reveal her identity to a police
officer and made a complaint while wearing a burqa saying the Crown didn't satisfy two key elements of the case beyond
reasonable doubt.
Judge Clive Jefferies has just passed down his official reasons for granting Carnita Matthews her appeal against a
six-month jail sentence after being found guilty of knowingly making a false complaint against a police officer.
The original court decision had found Mrs Matthews falsely claimed a racist police officer had tried to lift her burqa when
she was pulled over for a random breath test last June. It was allegedly she then subsequently made a false complaint
about the officer.
But Judge Jefferies said that he could not be "satisfied beyond a reasonable doubt" that it was Mrs Matthews who made
the complaint about a police officer at Campbelltown Police Station. She was wearing a burqa at the time.

He said the prosecution had made their case based on the signature of Mrs Matthews matching that on her statutory
declaration, which he said couldn't be proved as absolutely true.
He also said that even if it were Mrs Matthews who made the complaint, he was not satisfied beyond reasonable doubt
that she made it "intentionally" knowing it to be false.
Mrs Matthews lawyers have made a costs application on her behalf, with the mother of seven not in court for the hearing.
Meanwhile, Daily Telegraph online readers have voted overwhelmingly in favour of the police with an overwhelming
majority voting that police should have the power to demand women remove a burqa in an online poll.
Almost 12,000 people had participated in the online poll at thetelegraph.com.au as at 4.30pm.
"Should police have the power to demand women remove a burqua" was the question posed, with 96.57 per cent,
representing 11,592 people, voting yes and 3.43 per cent, representing 412 people, voting no.
Several readers also took the opportunity to share their opinions on the issue in the story, written by Clemintine Cuneo,
who spent a day wearing a burqa in two Sydney suburbs.

THE woman at the centre of the burqa row, Carnita Matthews, has a long record of driving offences and a history of not paying her fines.

Court documents have revealed that she had been fined seven times for traffic infringements before she was stopped by police in June last year for not displaying her P-plates in the incident that sparked the row that spilled over to the District Court yesterday.

Since she first received her learner licence in 1998 at the age of 33, she has twice had her provisional licence suspended for totting up too many demerit points and twice had her licence suspended for non payment of fines.The State Debt Recovery Office had to recover the fines. Both of those two suspensions for non payment of fines were later lifted.

It is not known how many times she was physically stopped by police and whether she had her face covered by a burqa or a niqab on those occasions. A number of times she was caught on camera speeding and disobeying traffic lights.

After being stopped by police last year for not displaying her P-plates, Ms Matthews was ordered to pay $276 in fines and court costs.

She claimed on Channel Seven and allegedly in a statutory declaration to Campbelltown police that the officer who stopped her had attempted to tear the burqa off her face, a claim that was proven untrue by the police patrol car video camera.

A magistrate last year found her guilty of making a deliberately false statement and sentenced her to jail for six months. Ms Matthews appealed, saying there was no proof she was the person in the burqa making the atatement and Judge Clive Jeffreys in the District Court yesterday upheld her appeal.

The news comes as women wearing a burqa may be ordered to remove it to identify themselves in the wake of the Carnita Matthews case.
Police Minister Mike Gallacher has revealed that police do not currently have the legal power to require women to show their face if the women refuse on religious or cultural grounds.

He said he wanted the law tightened up.

"Police powers in relation to face coverings are not clear," Mr Gallacher said.

"It’s time to address that."

He said he had spoken to rank and file police who wanted the situation clarified.

Any decision on whether to appeal the controversial judgment by Judge Clive Jeffreys would not be made until after the judge hands down the reason for his decision which is expected tomorrow.

The government is also considering passing new laws requiring people who make complaints against police, or in the case of witnesses giving evidence, to have to provide at least one fingerprint and their signature.

This follows the finding by the judge that he could not be certain that it was Ms Matthews who made the statutory declaration complaining about the officer who stopped her car because the person who handed the document in to the police station wore a burqa.

Mr Gallacher said he was waiting until Police Commissioner Andrew Scipione returned next week to discuss exactly what needed to be done.

He said he did not expect this to inflame community anger about women wearing full face coverings.

He said he had been told that there was nothing in Muslim culture or religion that stopped women from identifiying themselves in certain circumstances.

Yesterday, Ms Matthews avoided jail because her identity could not be proven.

Tempers rose and they began jostling with police after several members of the group attacked cameramen.

It marked a stark difference from their behaviour minutes earlier, when they had quietly assembled outside the lifts for prayer shortly after the judge's decision.

Mrs Matthew's lawyer Stephen Hopper defended their actions saying: "They are obviously happy with the result and are expressing it in a way that is culturally appropriate to them."

Judge Jeffreys said yesterday that even if Mrs Matthews had made the complaint, he could not be sure she knew it was a "false" statement.

"I am not satisfied beyond reasonable doubt that she made the complaint," he said.

"Even if I was satisfied that she made the complaint, I am not satisfied beyond reasonable doubt that it was knowingly false."

Mrs Matthews made the claim in her court appearance last year, saying police could not prove it was her behind the burqa when the complaint was handed in to police. The local magistrate rejected it.

The case had lit up the religious debate when a magistrate found Mrs Matthews had deliberately made false complaints that Sergeant Paul Kearney was racist and had attempted to tear her burqa off her face when she declined to remove it on request.

She was pulled over for a random breath test last June, and accused Sgt Kearney of racism only after he booked her for failing to properly display her P-plates.

The incident was captured on a patrol car video camera and helped clear Sgt Kearney, prompting calls for all police cars to carry in-built cameras to avoid false claims.

"I've got my P-plates on my car ... there was nothing wrong with how they were displayed," Mrs Matthews says on the video.

"You look at me and see me wearing this and you couldn't handle it. All cops are racist."

She then threatens, "100 per cent", that she will take the matter to court and fight the charge.

France was the first country in Europe to implement a full ban on covering up faces in public.

France's burqa ban descended into farce when the first women to be summoned before a European court for illegally wearing the garments were refused entry, because they would not remove their face coverings.

A 30-year-old man who stuffed ham into the shoes of Muslims as they worshipped at a mosque has been spared jail.
Jamie Knowlson also draped slices of the meat - which Muslims are banned from eating - on railings outside the mosque as his victims prayed inside, Britain's Daily Mail has reported.
The offender was captured on security vision as he abused worshippers after they confronted him over his sacrilegious act.
"Knowlson initially told police the stunt was a drunken joke but later admitted that he was fully aware of the offence his actions would cause," The Mail reported.
"He pleaded guilty to causing racially or religiously aggravated harassment and could have been jailed for up to two years, but walked free from Bristol Crown Court with a suspended six-month prison sentence because he had returned to the mosque to apologise for his actions."
During sentencing, Judge Carol Hagen told Knowlson that it was "difficult to imagine a more offensive incident".

"Imagine" this then, God forbid someone place ham in these Brave sons of Alla's shoes. 

"Not only the fixing of meat to railings but aggravated, in my view, that members of the mosque were inside praying at the time," she said.
The Mail said Knowlson went to the mosque from a nearby homeless shelter on January 9.
"(Prosecutor) David Hunter said it had been a premeditated attack specifically targeted at the Muslim community," it reported.
"Knowlson sat in tears as he was handed a six-month suspended sentence and 150 hours of unpaid work.
"A second man is due to stand trial in connection with the incident later this month."

A GROUP of Malaysian women launched an "Obedient Wife Club" overnight, urging members to be "whores in bed" and obey their husbands to curb social ills like divorce and domestic violence.

Islamic group Global Ikhwan held the club's inaugural meeting in Kuala Lumpur, giving women tips on how to keep their men satisfied and prevent them straying.

"A good wife is perceived to be prim and proper - you just take care of the children - but not much is emphasised on fulfilling sexual needs of the husband. If he needs sex, obey him," Rohaya Mohamad, the club's vice-president said.

Mrs Rohaya said 30 percent of the club members were in polygamous marriages while the rest were in monogamous relationships and that the club was open to non-Muslims.

"You must satisfy your husband. A good wife should be a whore in bed," said 46-year-old doctor, whose husband has three other wives.
She said the club boasted 800 Malaysian members so far with another 200 from across the Middle East.

Over 1000 guests and supporters turned up for the launch in a leafy suburb, held in conjunction with a mass wedding of ten couples, with the brides all members of the new club.

"If the wife is obedient, then the husband feels good and is entertained and this builds a closer relationship and greater love and no one strays," said groom Mohamad Shurahbil Amran, 23.

His bride Umuhani Lokman Hakim, 19, dressed in a golden white Arabic wedding gown, was unforthcoming when asked why she joined the club and would only say: "It is the right thing to do to keep the family together."

The club has come under criticism from Malaysian women's groups who say the onus on keeping a family together is being unfairly placed on women.

"With obedience comes submission, which may lead to domestic violence and marital rape," Women's Aid Organisation head Ivy Josiah said.

"We should really be forming equality in marriage clubs," she added.

Women's rights group EMPOWER said the club was a step back for the progress of the equality movement.

"We cannot go back to caveman days where the man pulls the woman by the hair and takes her to the cave to have his way. We must recognise that women contribute a lot more than just being a sex toy," the group's executive director Maria Chin Abdullah said.

Polygamy is legal for Muslims, who make up more than 60 percent of Malaysia's population, allowing Muslim men to take up to four wives.

In 2010, a study by a Muslim activist group found men in polygamous relationships find it difficult to meet the needs of all their wives and children, and that the result is often unhappy and cash-strapped families.

A FOREIGN student who sexually assaulted seven victims claimed he was upset at the way Australian women dressed and behaved, a court has heard.
Libyan masters student Almahde Ahmad Atagore, 28, was this morning jailed for at least three years over the assaults in August and September last year.
He had been in the country only a month, on a sponsorship funded by his government.

But County Court Judge Margaret Rizkalla said Atagore wasn’t prepared for the cultural differences and felt isolated and depressed.
He indecently assaulted two teenagers leaving the Mentone Hotel, laughing at them afterwards.
Atagore returned another night to attack two more outside the same pub.
Two more victims, including a 13-year-old girl, were assaulted as they used escalators at Flinders St station.
Another, 17, was attacked outside Mentone train station.
Atagore was identified in footage from Flinders St and cameras outside the hotel, but when confronted by police denied he had molested the victims.
Judge Rizkalla said he struggled to adapt to Australian life, without a mosque nearby and with little support.
Atagore told a psychiatrist he was upset at the way local women dressed and behaved, leaving him feeling both angry and aroused.
But he now felt shame and regret for his crimes, the judge said.
She said Atagore was suffering from an adjustment disorder, which contributed to his offending, and would face a hard time in prison with his poor grasp of English.
But the attacks happened in public places and had left the victims fearful of public transport, robbing them of security and independence.
Several of the victims were in court and welcomed the maximum sentence of five years and three months, with at least three years to serve before being eligible for parole.
Atagore pleaded guilty to five counts of indecent assault, one of assault with intent to rape and one of committing an indecent act with a child.
Police were unable to check his criminal past due to unrest in Libya.
But Sen-Det Dion Achtypis said outside court that Atagore’s nationality was not a factor in his crimes.
“There are many, many overseas students in this country who are law-abiding citizens,” he said.

CHRISTIANS in Sydney will have their core beliefs challenged by provocative advertisements due to appear on billboards and buses in the next month.

The ads, paid for by an Islamic group called MyPeace, will carry slogans such as ''Jesus: a prophet of Islam'', ''Holy Quran: the final testament'' and ''Muhammad: mercy to mankind''.

A phone number urges people to call to receive a free Koran and other Islamic literature.

 

“The Anglican Bishop of South Sydney, Rob Forsyth, said it was ''complete nonsense'' to say Jesus was a prophet of Islam. ''Jesus was not the prophet of a religion that came into being 600 years later.''

But the billboard was not offensive, he said. ''They've got a perfect right to say it, and I would defend their right to say it [but] … you couldn't run a Christian billboard in Saudi Arabia.''

The organiser of MyPeace, Diaa Mohamed, said the campaign was intended to educate non-Muslims about Islam. He said Jesus was a prophet of Islam, who was to come before Muhammad. ''The only difference is we say he was a prophet of God, and they say he is God,'' Mr Mohamed said. ''Is it thought-provoking? Yes, it is. We want to raise awareness that Islam believes in Jesus Christ,'' he said.

Mr Mohamed said he hoped the billboards would encourage Christians and Muslims to find common ground. They were not intended to downgrade the significance of Jesus. ''We embrace him and say that he was one of the mightiest prophets of God.''

MyPeace plans to extend the campaign, funded by private donations, to television.

A spokesman for the Australian Islamic Mission, Siddiq Buckley, said the campaign would increase awareness of the positive facts of Islam. ''I would be looking at this as a good opportunity to explain what we mean.''

A NSW police officer shot in a botched hotel robbery that led to a four-hour siege with hostages has lashed out at the gunman's "joke" sentence.

Sergeant Stephen de Lorenzo, who bared his scarred shoulder outside the Sydney court on Monday, said he was furious with the judicial system and his attacker's jail term.

 

"This guy needs to go away for 25 years, close the door. He shot a police officer with intent to murder. He was holding hostages with a firearm to their head," Sgt de Lorenzo told reporters on Monday.

"He will be out in the community in 11 years. It's an absolute outrage. It's a joke."

NSW District Court Judge Deborah Sweeney sentenced Tevi Koloamatangi, 41, to a maximum of 15 years for a string of offences, including those related to The Lakes Hotel robbery in the eastern Sydney suburb of Rosebery in May, 2009.

"I wouldn't mind going back to the front line to have one more chop at these mugs that shoot cops," Sgt de Lorenzo said. "Judge Sweeney, sitting there with a plum in her mouth, living on the north shore of Sydney, doesn't understand the problems on the streets of Sydney." Sgt de Lorenzo earlier had told the jury he was shot in the right shoulder while trying to protect three staff members who had been taken hostage.

He described people screaming and whimpering, with one man yelling "God save me! God save me!", and thought they would be executed.

The judge accepted Koloamatangi's evidence that he was affected by amphetamines, cocaine and ecstasy and had prolonged the situation because he feared for his own safety.

But, she said, he could have surrendered rather than shoot.

"I have found Mr Koloamatangi was not lying in wait for Sgt de Lorenzo. However, when he saw Sgt de Lorenzo, he shot at him," she said.

A sentencing hearing was told Koloamatangi turned to illicit substances at a young age to self medicate for his troubled childhood, which included years of homelessness.

"He confirmed in evidence he can't say no to drugs," the judge said.

She accepted his feelings of remorse, although he had maintained his innocence on the most serious charge of shoot with intent to murder, for which he was sentenced to a minimum of six years.

But Koloamatangi will spend at least 11 years in jail for seven offences, including two unrelated to the robbery.

He will be eligible for release in May 2020.

Co-accused Emad Raad, 27, who drove Koloamatangi to the hotel and remained on lookout until police arrived, was found guilty of charges including shooting with intent to murder.

He was sentenced to a minimum term of five years and will be eligible for parole in June 2016.

Koloamatangi's relative, 49-year-old Silivesiteli Lopeti, a security guard at the hotel, was cleared by a jury of all charges after the Crown alleged he faked being a victim and was actually "in on the deal".

Sgt de Lorenzo said his life had been "terribly affected" by the incident and he had been laid off from the NSW police force due to post-traumatic stress disorder.

"They hailed me as a hero," he said.

"I'm no hero. I'm just an ordinary cop that did an ordinary job.

"I'm furious because there's gonna be other young police officers shot in the line of duty ... and I want increased sentences for these people."

Update: The would be killers cheer squad has now accused  Sergeant Stephen de Lorenzo,of been a Racist for telling them to "go back home where they came from" had Sergeant Stephen de Lorenzo just died instead of surviving their pin up boys bullets I guess he would been just playing his part in the "enrichment"  "diversity" of Australian Society by the Australian Labor Party's "Harmony Day" messengers of Peace,Diversity and Cultural enrichment.

Note the Immigration Departments Interpreter deciding to become "a player" rather than a simply doing her job of interpreting inside the Court, but perhaps her loyalties are to a wannabe Killer from the same country that she also ran away from,than to Australia.
I wonder did she interpret or construct answers for the wannabe Cop Killer for the the Good Judge.
I have seen first hand how these Immigration Department Interpreters take an activist role whilst allegedly simply transfering questions and answers between the “non English speaking” accused and the Court and its officers.
