A JUDGE has decided to release the signatures at the heart of a decision to overturn the six month jail sentence of Carnita Matthews for making a false complaint to police.
Judge Jeffreys said last week he could not be satisfied that Matthews had made the statement claiming a highway police officer was racist and had moved to rip the full face niqab off her head - because the woman who handed it to police was wearing a full face niqab, which is similar to a burqa.
He could not be sure beyond a reasonable doubt that it was the Muslim's  woman's signature on a statutory declaration handed to police.
But earlier today Ms Matthews' lawyer Stephen Hopper had stated in court that it was her signature on the disputed document.
The amazing statement came in the District Court while The Daily Telegraph was seeking permission to publish the signature at the heart of the case on the statutory declaration.
In the original case the prosecution argued  the signature matched one on her driver's licence but the judge said there were a number of differences.
The Daily Telegraph had been refused permission by the registrar of the District Court to reproduce the signatures but this afternoon Judge Jeffreys overturned the registrar's ruling.
The case began in June last year when Ms Matthews, 47, had been stopped for a random breath test and was booked by Sen-Constable Paul Fogarty for not properly displaying the rear P-plate on her black Honda Odyssey.
She claimed through her lawyer  it could not be proven it was her who made the false complaint to police that the officer had been racist, a complaint shown not to be true by the police in-car video of the traffic stop.
Magistrate Robert Rabbidge, who convicted her last year and sentenced her to jail, said the two signatures were "almost identical.''
In court this morning, counsel for The Daily Telegraph James Hmelnitsky said the newspaper had been denied permission to publish the signature by the court registrar.
He said that was effectively a suppression order and the judge had the discretion to allow the publication in the administration of open justice.
Ms Matthews was not in court and Mr Hopper opposed The Daily Telegraph's application to publish the signature saying it would be an invasion of her privacy.
"They are not just seeking the documents. They are seeking the signature of my client," he told the court.
Counsel for The Daily Telegraph James Hmelnitsky said this went to the heart of open justice.

AMERICAN comedian and actor Jerry Lewis was forced to abandon a scheduled concert at Rooty Hill RSL after falling ill just moments before he was to front a sold out concert at the western Sydney venue.

The 85-year-old is currently on his eighth Australian tour doing a series of concerts for the Muscular Dystrophy Foundation of Australia a charity he has so far raised more than $2.45 billion worldwide during the past 61 years.

The veteran Hollywood funnyman also known as the King of Comedy told a News Limited journalist in an exclusive interview in his hotel room just hours before he was to take to the stage of his "love of Australia and great no-nonsense Aussies" he has befriended during his visits.

"Australian people have always treated me like a friend ever since I remember visiting the Wrestpoint Casino back in 1970 I ended up staying there for four weeks," Lewis said.

"It's a beautiful country filled with honest beautiful people."

Chief executive officer of Rooty Hill RSL Richard Errington said he was with Lewis when he arrived at the club's entrance and said the ageing comic looked ill.

"He couldn't even get out of the car, he was pale and looked extremely unwell," he said.

But the club CEO said he was heartened when he went on stage to advise the sell-out crowd of Lewis' cancellation.

"I told the audience they could have refunds but they rose as one and gave Jerry Lewis a personal standing ovation of support and said his charity could keep their ticket proceeds as a donation.

"It was a very touching gesture that was recorded and will be seen by Mr Lewis when he is well."

It is understood Lewis was being treated by a doctor, but it was unclear whether he was transported to hospital for treatment.

Convicted killer to become an Aussie

An Iranian stowaway, who stabbed to death a priest who was caring for him, has been found to be of good character and should be given Australian citizenship.

Efforts by the Immigration Department in the past 18 years to deport Hassan Baharestan have failed and the department was told this week that it must make the 55-year-old an Australian citizen.

Arguing the case in the Administrative Appeals Tribunal, the department said Mr Baharestan's crime was "of the type that all Australians would find repugnant and involved an act of significant violence which resulted in the death of an Australian citizen".

"The circumstances of this particular offence are such that the Australian community would not want a person who has committed such a crime to become an Australian citizen," the department said.

In 1993, Mr Baharestan was convicted of manslaughter for the death of Church of Christ minister Douglas Good, a priest who had helped him settle into the Fremantle community after he received a permanent visa in 1989.

It was claimed during the trial that Mr Baharestan had been pressured into having sex with the priest under the threat of deportation. During an angry disagreement at the church's Fremantle manse, Mr Baharestan stabbed the minister with a kitchen knife, causing the priest to bleed to death.

He was sentenced to five years and 10 months jail. He was released on parole after three years.

During its attempts to deport Mr Baharestan or cancel his visa, the Immigration Department Immigration argued that he did not meet the good character test required of applicants.

But Mr Baharestan has fought against them every step of the way, arguing he had not been involved in any other criminal behaviour since the priest's death and had tried to make a life in Perth.

He admitted being charged with sexually assaulting a fellow patient at a Sydney mental health institution shortly after his release from prison but it was dropped because of a lack of evidence.

The tribunal found that Mr Baharestan's manslaughter conviction was due to "aberrant behaviour" and that he was of good character for the purposes of the Australian Citizenship Act.

Yesterday, Mr Baharestan declined to speak to _The Weekend West _ at his Fremantle Homeswest unit, saying his crime was a long time ago.

In a letter to the department, he pleaded to be made a citizen.

"The Australian quality and way of life are what I strive to embrace and I hope you will allow me to do so," he wrote.

Members of the Fremantle Church of Christ congregation were outraged to learn that Mr Baharestan was on the verge of being granted citizenship.

Shirley, who did not want her surname published, said the crime had sent shockwaves through the community.

"It was horrendous," she said. "I was told there was blood everywhere. I thought (Mr Baharestan) would have been sent out of the country right away."

Mr Baharestan's lawyer Stephen Walker said his client had been well behaved before and after his crime and had managed his mental health issues well.

"I would like to stress the importance of all the facts, including the length of time since Hassan committed the offence, his good behaviour before and since the offence, and the favourable

opinions of those who know him well," he said.

"Hassan has shown himself to be a contributing resident deserving of citizenship."

Friends of Mr Baharestan described him as being decent and calm.

The Immigration Department has 28 days to appeal the tribunal's decision but only if there is a jurisdictional error in law. Immigration Minister Chris Bowen has no power to intervene.

The Australian Immigration Departments BAR is set low enough as it is, and allows virtually any illegal non deserving applicant it can find into Australia, on the rare occasion that they find some one that, by granting them citizenship or residency would create too much negative publicity,they leave it to their Star Chamber,the Administrative Appeals Tribunal, to do their dirty work for them as per this case.
