Police assault case: Woman who allegedly hit officer was illegally detained, lawyer says

A WOMAN who allegedly punched an officer and threatened to slit the throat of another during a counter terrorism raid had a right to resist the search, her lawyer claims.

The 24-year-old woman, whose name is suppressed, allegedly called the female police officer a “whore” and told her she would have her “throat slit” when she was searched and a mobile phone confiscated during a raid last year.

The woman has pleaded not guilty to assaulting and intimidating police when they seized her mobile phone underneath her burqa.

At a hearing today at Parramatta Local Court, her lawyer Steven Boland said she had been “illegally detained” as police had never shown her a search warrant, explained why she was in custody or searched her in a reasonable amount of time.

As he grabbed her left arm, he said she punched him in the nose with her right fist.

She was not the target of the search or named in the warrant.

“Anyone who is being illegally detained has every right to resist — every right.”

So Muslims can now define Australian Law and it's implementation as been lawful or unlawful on the spot and resist with violence and threats of throat slitting of NSW Police Officers executing their duty should they think appropriate at any given time they face Police apprehension?

Mr Boland told the court the woman had “put up with” being detained for some time until police seized her mobile phone.

Senior-Constable Stacie Gwyn, who had searched the woman, had previously given evidence that when she tried to take her phone, the accused said: “Don’t touch my phone, you’re a whore, you are Christian, you will burn in hell. You will be the first one in uniform to have your throat slit.”

Probationary Constable Shaun Temur told the court after an alleged struggle to take the phone, he tried to restrain the woman.  
As he grabbed her left arm, he said she punched him in the nose with her right fist.

Mr Boland told the court his client had been waving her arms and did not intentionally hit the officer.

“When she had five officers around her, she was free to leave then? She was clearly not free to leave.”

Constable Temur told the court the woman said officers had “no right to search me, you dogs.”

Scott Murphy, the federal police agent who ordered the search, told the court she overheard the woman tell Sen-Constable Gwyn: “You can’t touch me, you like getting gangbanged? You are in uniform — you must like it. The only one who has the right is God.”

Under cross-examination, agent Murphy told the court the occupants of the house were not shown the search warrant until about 90 minutes after armed police stormed the home at 4.30am.

Agent Murphy said after the occupants were removed, he tried to “engage them in conversation” before showing them the warrant.

Mr Boland asked: “You have to show them the warrant, do you?”

“Yes,” agent Murphy replied.

“It is a very important process and you record it if you show them the warrant — did you do that?

“No, I did not record it, it was recorded at the house (at 6.04am) but not prior.”

Agent Murphy said when he ordered police to search the woman she was not under arrest or detained.

“What are you saying?” Mr Boland asked. “When she had five officers around her, she was free to leave then? She was clearly not free to leave.”

Agent Murphy said although she was not under arrest, he ordered she be searched and her mobile phone seized because he believed she was “carrying seizable items” in connection to the raid.

The phone was later returned to the woman.

AN associate of Auburn deputy mayor Salim Mehajer is alleged to have threatened two reporters while he was awaiting sentencing at a Sydney court.

Waled Elriche, of Auburn, Walid Elriche, who was recently filmed walking with Auburn deputy mayor Salim Mehajer, was sentenced to a minimum of nine months behind bars at Parramatta Local Court this afternoon for his use of stand-over tactics.

Mr Elriche was a guest at Mr Mehajer’s lavish wedding earlier this month.
Channel Nine reporter Airlie Walsh was inside the court building getting a cup of tea when Mr Elriche allegedly approached her. She said he told her: “You find me, I can find you.

“I’m not trying to threaten you, but you know my criminal history. Don’t be stupid.

“There’s a lot of reporters around that can get hurt.

“I’m telling you this because you’re a woman. Don’t get involved in a man’s business.”

Ms Walsh said she felt shaken after the incident.

Channel Seven reporter Bryan Seymour said he was also threatened by Elriche inside the building near the courtroom.

He said Mr Elriche unleashed a torrent of abuse against him which allegedly included the phrase: “I’m gonna f ... ing kill you.”

Mr Seymour said Mr Elriche also told him: “Stay away from my brother. You found me. I can find you.”

Both journalists reported the incidents to police at the courthouse.

Police allege he kicked down a door and demanded repayment of a $25,000 debt in behalf of a friend at Castle Hill last March.

A FORMER SAS soldier chosen to fight the WA Canning by-election for Prime Minister Tony Abbott has delivered an extraordinary speech responding to allegations that soldiers under his command cut off the hands of dead Taliban soldiers.

Captain Andrew Hastie, 32, has revealed in his first public speech to the WA Liberal Party that he ordered the investigation into his own troops and was personally cleared of any wrongdoing.

“I have now left the Defence Force with a clean slate, having defended our nation against the Taliban and Daesh,” he said.

“I am now taking the skills I learned in the army and if elected will use them to be the best representative for the people of Canning.

“I have not lived my life behind a desk pushing paper and talking about the concepts of freedom and democracy. I have acted. I have put my life on the line for this country and for that freedom.’’

He also accused Labor of “not having our backs’’ when he was fighting in the Middle East, an issue that prompted him to enter politics.

For the first time, Captain Hastie also revealed that not only was nowhere near an incident, he was in the helicopter.

Confronting allegations splashed across Fairfax newspapers today that officers under his command are still being investigated, he also criticised the length of the Defence investigation.

The allegations were published in Melbourne’s The Age newspaper under the headline “Question of conduct’’ in a report that noted Captain Hastie was not involved in the incident or present when it occurred.

It is alleged that the hands of three Taliban fighters were cut off for the purpose of fingerprinting in 2013.

“I can say with great confidence that those soldiers involved directly with the incident were acting in what they believed to be the appropriate process laid out by defence.”

Captain Hastie acknowledged that mistakes sometimes happen in a “high-pressure war zone where people are trying to kill you’’.

“It is true as reported that I wasn’t at the scene of the incident when it happened. I was in fact above and away in a helicopter orbiting overhead,’’ he said.

“When I became aware, I did what I was required to do and promptly reported the incident up the chain of command.

“I can say with great confidence that those soldiers involved directly with the incident were acting in what they believed to be the appropriate process laid out by defence.

“As the then Defence Force chief David Hurley said ‘We were engaged in a high intensity, complex and dangerous battle’. It is critical when you fight the Taliban that you gather evidence and do what you can to investigate ... the identification of your enemy.’’

“He’s fought for our country in the field. He will fight for Canning in Parliament.”

Captain Hastie also revealed that an inquiry had found “my actions at the time were appropriate’’.

“All but one of the troops was cleared,’’ he said.

“The investigation was launched after the issues was raised up the chain of command and it was raised by me.

“The investigation into this single soldier has taken two years and four months and it hasn’t been finalised. As reported, there are differing views as to whether the incident constituted a breach of the rules of war.

“People who serve, put their lives on the line to protect our country. I have always stood up and fought hard to represent the troops I lead and if that requires ruffling feathers, I have done that and I will do that again now.

“Out of concern for the soldier involved, I am disappointed that my candidacy has brought this issue to the forefront of media attention.

“The least we can do for that honourable soldier is to ensure that the investigation into the incident is done fully and quickly.

“This issue has cast a shadow for almost two and a half years over this man’s life. I believe the Defence Force has a duty of care to finalise its investigation more quickly.”


The Prime Minister said he was proud Captain Hastie had chosen to extend his public service into politics.

“He’s fought for our country in the field. He will fight for Canning in Parliament,’’ Mr Abbott said.
