Vincent GioiaEver since Obama called for a new domestic army many people waited for the next shoe to drop after his election as president but who would have expected the jackbooted knocker on your door to come from the Federal Communication Commission — "I'm from the FCC and I'm here to confiscate your computer." You may not know it, but if you have a wireless router, a cordless phone, remote car-door opener, baby monitor or cell phone in your house, the FCC claims the right to enter your home without a warrant at any time of the day or night in order to inspect it.

For many years the agency has followed this rule to monitor licensed television and radio stations, and to crack down on pirate radio broadcasters but now the FCC says the same policy applies to any licensed or unlicensed radio-frequency device. Speaking for the FCC, spokesman David Fiske said "Anything using RF energy — we have the right to inspect it to make sure it is not causing interference." That includes devices like Wi-Fi routers that use unlicensed spectrum, Fiske says.

The FCC claims it derives its warrant-less search power from the Communications Act of 1934, though the constitutionality of the claim has gone untested in the courts because the FCC had little to do with average citizens for most of the last 75 years when home transmitters were largely reserved to ham-radio operators and CB-radio aficionados. But in 2009, nearly every household in the United States has multiple devices that use radio waves and fall under the FCC's purview, making the commission's claimed authority.

I believe it's a major stretch to assert what the FCC claims is its authority with respect to a private home; this is at the core of the Fourth Amendment's protection against unreasonable search and seizure. The idea that a cell phone or a Wi-Fi connection suddenly makes the federal government able to invade your home for a warrant less search is more than bizarre. George Washington University professor Orin Kerr, a constitutional law expert, also questions the legality of the policy. In reference to a 1967 Supreme Court ruling that housing inspectors needed warrants to force their way into private residences Kerr pointed out:

The Supreme Court has said that the government can't make warrant-less entries into homes for administrative inspections.

The FCC has not explained how the agency gets around that ruling. The FCC rules came to public attention this month when an FCC agent investigating a pirate radio station in Boulder, Colorado, left a copy of a 2005 FCC inspection policy on the door of a residence having an unlicensed 100-watt transmitter.

The FCC statement said:

Whether you operate an amateur station or any other radio device, your authorization from the Commission comes with the obligation to allow inspection.

A corollary of the newly claimed and enforced FCC policy is that if inspectors should notice evidence of unrelated criminal behavior — say, a marijuana plant or stolen property — another Supreme Court decision suggests the search results can be used against the resident. In the 1987 case New York v. Burger, two police officers performed a warrant-less, administrative search of Joseph Burger's automobile junkyard. When he couldn't produce the proper paperwork, the officers searched the grounds and found stolen vehicles, which they used to prosecute him. The Supreme Court held the search to be legal.

Refusing the FCC admittance can carry a harsh financial penalty. In a 2007 case, a Corpus Christi, Texas, man got a visit from the FCC's direction-finders after re-broadcasting an AM radio station through a CB radio in his home. An FCC agent tracked the signal to his house and asked to see the equipment;

Donald Winton refused to let him in, but did turn off the radio. Winton was later fined $7,000 for refusing entry to the officer. (The fine was reduced to $225 after he proved he had little income.)

The new government claimed authority takes on even more dire prospects when you consider that it is reported Obama is considering a "preventive detention plan." President Obama told human rights advocates at the White House recently that he was mulling the need for a "preventive detention" system that would establish a legal basis for the United States to incarcerate terrorism suspects who are deemed a threat to national security but cannot be tried, according to two participants in the private session.

The discussion, in a 90-minute meeting in the Cabinet Room that included Attorney General Eric H. Holder Jr. and other top administration officials, came before a speech Obama gave on a number of national security matters. The two participants, outsiders who spoke on the condition of anonymity because the session was intended to be off the record, said they left the meeting "dismayed." If it were me I would have said "downright terrified."

The participants also said Obama told them he was thinking about "the long game" — how to establish a legal system that would endure for future presidents.

He raised the issue of preventive detention himself. It is reported Senior White House officials did not respond to requests for comment on the outsiders' accounts. "He was almost ruminating over the need for statutory change to the laws so that we can deal with individuals who we can't charge and detain," one participant said.

The other participant said Mr. Obama did not seem to be thinking about preventive detention for terrorism suspects now held but rather for those captured in the future. "The issue is," the participant said, "What are the options left open to a future president?" To that I say "balderdash"; with Obama's record of expanding government power and intruding on civil rights, it is more likely Obama wants to couple his new Socialist/Marxist society with Nazi-like powers.

In the World War II era people had to play their radios in the dark; have we come to the time when we will have to secret our computers and cell phones?

If Obama and his lefty mates had half the brains they pathetically think they have they would be keeping a close eye on the UK and Australia. Obama's 'economic policy' of spend, borrow and print the stuff — and keep on doing it — was also the policy of the British Labour Government. Thanks to that economic stupidity Britain is now on the brink of financial ruin and the economy is expected to contract this year by something like 4 per cent. The Australian economy is also continuing to contract despite Prime Minister Rudd's outrageous spending binge that has sent the country deep into the red for years to come.

The problem — as always — is one of lousy economics. While our economic punditry focus on consumer spending and fiscal policy they have completely overlooked the monetary situation. All the inflation indicators have been slowing since last September while M1 has been basically flat since May 2009.

Moreover, the decline in the Reserve's assets has accelerated. The latest monetary figures (they are always about two months behind) show that from February to March M1 actually contracted. In short, monetary policy is very tight.

When monetary policy tightens this should result in a slowdown in production, falling investment, rising in unemployment and a contraction in import volumes. (Westpac calculates that import volumes dropped by about 14 per cent over the Q4 and Q1). The latest figures from the Australian Bureau of

Statistics show that spending on equipment fell by 10.8 per cent in the March quarter. This is the biggest drop since this survey started in 1987. To get a better idea of how bad the situation is we need to look at manufacturing figures. The May Australian Industry Group report for April revealed that manufacturing had been contracting for eleven straight months. Australia is clearly in recession and has been for sometime.

Regardless of what the economic commentariat believes, manufacturing is a key indicator — not consumer spending. Focusing on the latter leads to confusion. Rudd's $8.4 billion cash handout represented about 3 per cent of GDP. Not surprisingly retail sails jumped by 1 per cent in the first quarter. We could get a repeat performance when most of Rudd's additional $12.7 billion injection is released in the second quarter.

As I have stressed many times before, consumer spending is only about one-third of total spending. Failure to recognise this fact comes from the fallacy that to include spending between firms in the national accounts would be double-accounting. (Businessmen are genuinely surprised when I tell them this).

Therefore it is not consumer spending but total business spending that should be monitored. Once this is realised it becomes obvious that the Australian economy went into recession last year and is still tanking. There is no way that running down the surplus and increasing government debt could have stopped this process. And there is certainly no way these policies can reverse the economy's direction. Given the Reserve's monetary stand fiscal policy in the form of greater government spending is powerless.

Treasury and Reserve officials are at a loss to explain the situation, something that Ric Battelino, the deputy governor of the Reserve Bank, made clear when he asserted that the principal reason for the difference between the sickly state of business and the current state of the housing market is the significant difference in borrowing costs, with the variable mortgage averaging 5.16 per cent while — according to Alan Kohler of the Business Specator — "the current borrowing rate for non-financial companies is 7.29 per cent".

However, since similar differences in borrowing rates exist in the US and Europe the Treasury can scarcely assert with a straight face that Australia occupies a unique position in this respect. The difference is easily explained. Firstly, as already noted, recession strikes at manufacturing first* and hence its effects will be first felt in business spending and not in consumption. In fact, consumption can continue to rise even as a recession deepens. This happened during the recession that Bush inherited. This means that any differences between borrowing rates for business and borrowing rates for housing are irrelevant.

Secondly, the government has used subsidies and low interest rates to maintain the level of Australian house prices regardless of business conditions. It's true that the US has done likewise but unlike America's utterly reckless Democrats neither the Labor Party nor the Liberal Party bullied lending institutions into giving mortgages to people who were patently unable to afford them.

Furthermore, several things need to be noted about housing. There is no housing market as such. What we have are a very large number of housing markets.

Houses in Endeavour Hills are not the same as houses in Toorak. Even within suburbs one can find a number of housing markets. Finally, it should be obvious that one cannot compare one country's 'market for housing' with that of another. Supply and demand conditions will always differ.

Mr Battelino is self-evidently clutching at straws.

*Housing too can be indicator because of its sensitivity to changes in interest rates. However, this sensitivity can evidently be blunted where mortgage rates are kept low.

A controversial Islamic school will not be built in Camden after a court today rejected an appeal by the school's backers.

The Land and Environment Court rejected the Quranic Society's application to build a $19 million school for 900 students in a rural area on the outskirts of the town south-west of Sydney.

It found that the plans were inconsistent with the site's zoning restrictions.

Camden City Council cited planning arguments when it first blocked the proposal a year ago.




But fierce community opposition to the project often relied on racial and religious arguments.

The case attracted international media attention when two pigs' heads were rammed onto metal stakes at the site, on the corner of Cawdor and Burragarong roads, in 2007.

And at the hearing in April, the council's evidence included a letter signed by four Christian churches stating that Islam espoused views that were "incompatible with the Australian way of life".

The council's legal team also presented a DVD featuring the views of concerned residents, one of whom said the school would be a "breeding ground for terrorists".

However the council insisted its refusal was based on planning grounds, arguing it was incompatible with the rural zoning and would cause problems for traffic and neighbouring farms.

The Camden case has been the most high-profile bid to keep Islamic schools out of areas the outskirts of Sydney.

Since the Quranic Society's application was first blocked in 2007, several other applications for schools have faced strident opposition from communities on the suburban fringe.

One of the biggest Islamic schools in Australia - a 1200-student school in Bass Hill - will be built after its backers won an appeal in the Land and Environment Court last month.

This will not be the end of this matter, the Islamic colonialists, will, I am sure, appeal against this ruling.... lets hope they are unsuccessful fingers crossed.
